I have never forgotten our family's encounter with Kristin Timm. Nearly 30 years ago, Kristin Timm's apathetic negligence to providing competent legal representation for my son began a nightmare for our family and an outcome that nearly destroyed our son's life and future fro...m age 14 forward.
Our experience was in the late 1990's. She was the court appointed attorney for our son and represented him in Denny Youth Court in Everett, WA.
My sons charges were for burning a detention slip in his High School boys bathroom waste basket. The crime had a sentencing range of 2 weeks. He was taken from the HS to Everett Denny Youth Center for detention for several days. On his court date, my husband and I arrived 1/2 hour early for the hearing before the Judge. We sat alone in the middle of the lobby in front of one of the court rooms. There were no other people in the lobby, it was literally empty.
About 10 minutes before the time for my son's court hearing, a door opened in a wall across the lobby from the court rooms and a big woman walked across the lobby toward the court room doors. She looked at us but said nothing, and she proceeded onward into a court room. We did not know at that moment that the woman was Kristin Timm our son's court appointed Attorney.
The time for our son's hearing came and went. We did not know what to do because we had been told to wait for our son's attorney to meet us in the lobby and walk with us to the court room. Finally after about 15 minutes, I became concerned that the court hearing may be underway and no one had come to get us. I got up to begin opening court room doors to look into each court room to see if our son's Hearing had begun. The first door I went to was the one the woman we'd seen earlier had entered. Our son was in that courtroom in an orange jumpsuit seated facing the Judge. The hearing was nearly over. When we came in all talking stopped. My husband and I realized the woman sitting to our right was our son's Attorney; the same woman who had looked directly at us sitting alone in the lobby and ignored us. She glanced at us and blandly looked away back to the Judge.
The Judge asked who we were? We explained we were the parents, had been in the lobby waiting to be called to court for nearly 45 minutes, had never met our son's attorney, and she'd walked by us earlier and not called us to the hearing. The judge said they'd already gone over and discussed my son's case and were ready to sentence him. He asked did my husband or I wish to make a statement? We explained our viewpoint that our son was in his first year of high school after having been home-schooled the majority of his education. and he'd never been in trouble prior to now. We hoped for a short sentence and to bring him home where we would supervise him more closely.
The Judge told us that they disagreed, this case warranted a "Manifest Injustice." He sentenced our son to TWO YEARS in MAPLE LANE Psychiatric Detention Center, CHEHALIS, WA. My pleading for a lesser sentence and for him to be in detention closer to our family home fell on deaf ears. Kristin Timm never spoke to us, nor did she advocate for our son to the Judge. The Judge told us we could appeal but we were unable to afford the cost.
Our son was in Maple Lane Detention for 18 months, beat up by two guards and for him defending himself, WA State attempted to keep him in Maple Lane until age 21 (5 more years). At this point a family member paid for us to retain a "real attorney." The attorney we hired had our son out of Maple Lane Facility and back home in two weeks, all charges for our son defending himself against the guards were dropped, and the attorney we hired (a former Chehalis , WA Prosecuting Attorney) told us that our son spending 2 years in Maple Lane Psychiatric Detention Center for a 2 week sentence range was itself the "Manifest Injustice."
