Poor Service and Bad Attitude

I had a terrible experience with Mr. Linville and I am happy to have this opportunity to share my thoughts. I am a small business owner. A client of mine had an overdue bill for $4,500. She sent me a letter enclosing a check for half that amount, and refused to pay more. I deposited the check a...nd called Mr. Linville to find out if there was anything I could do to force the client to pay the balance. I told him I had received a check for partial payment along with a cover letter. He enthusiastically suggested that we file a lien on my client's house. He asked to see the cover letter, but before I could get him a copy he proceeded to file the lien that same day. He seemed to be in quite a rush. It turns out that the lien was improperly filed because the cover letter from my client included a statement that the enclosed check was "payment in full." When we learned this Mr. Linville withdrew the lien, but insisted that I pay him $600 for his time and filing fees. I politely explained that I did not think it was fair to expect me to pay that amount, because I had depended on him to tell me what my legal rights were before taking action on my behalf, and he had not even bothered to read the cover letter (or even ask me what it said) before filing the lien. He sternly lectured me about how it was my responsibility to understand the legal implications of the partial payment and "payment in full" clause in the cover letter (which he never bothered to read). He insists that it is not his job to "inquire" into the basis of his clients' claims before filing liens on their behalf. I offered to pay half of his bill to be done with the matter, but he refused and instead sued me in small claims court for the whole amount, plus interest. In short, when I first contacted Mr. Linville I was looking for advice as to what my legal rights were. He thinks it was my responsibility to know my rights before calling him. This has been a very bad experience and I would strongly recommend that other business owners look elsewhere if they want an attorney who is careful, asks appropriate questions, and doesn't blame his clients for his own oversights.

I'm sorry you are upset, but I did nothing wrong. I have reviewed this matter with several other attorneys and all are of the same opinion. When a new client comes to me and tells me that their customer owes them money and they ask me to file a lien on their customer's house, I take the client at their word that they are owed the money. In this case, unbeknownst to me, my client had previously deposited a check marked "paid in full" from her customer. After I filed the lien, the homeowner's attorney called me and told me about the check. I then advised my client that we should release the lien and drop the matter because depositing a "paid in full" check results in a waiver of all claims. This is known as the doctrine of "accord and satisfaction". Of course, if my client had told me at the outset that she had previously deposited a check marked "paid in full" then I would not have filed the lien and instead would have told her to abandon her case. If a client wants me to review their entire file before I file a lien, I'm happy to do that, but makes things much more expensive for the client, and often unnecessary, since most of the time after I file a lien, my client gets paid shortly thereafter with very little work or billing from me.

Concise and to the point

Hiring a lawyer to resolve a dispute with our contractor regarding the horrible installation of our bamboo flooring was a last resort, and the absolute last thing we wanted to do. David Linville helped us resolve the process as quickly and as painless as possible (though the process was still somewh...at painful, of course). He knew the law well, and did not waste time. He was succinct and professional. We had consulted with another lawyer specializing in the same thing, but I am so glad we went with Mr. Linville, as he knew what we should ask for and how to go about doing it. I am convinced any other route would have been quite a bit more costly. I was concerned that his office was over an hour away, but all correspondence was through phone or email. We had done our homework in hiring a certified flooring inspector, getting several written estimates detailing itemized costs, and in communicating (exclusively through email) with the builder for 6 months to try and get the issue resolved without legal help, so were confident in our case. Our hope was to also get the builder to cover the cost of inspection and legal fees, but in the end paying those costs was well worth getting the problem property resolved. I would absolutely recommend Mr. Linville and his firm to a friend, though I hope to not have to use him again. He has gained my respect again when I called to see if we could hire him to help us with a real estate transaction, and he referred us to another lawyer after explaining that he (wisely) sticks to his specialty.

a bright spot in the industry

I used David Linville to represent me in a lawsuit to fight a construction lien claim as well as counter claims I had vs the plaintiff. David was professional, responsive, very fair on his billings, knowledgable allowed me to be involved as much as I desired, and kept me in the loop all along the wa...y. During the course of the lawsuit due to David's clever thinking we won a partial summary judgement invalidating the lien claims which I considered a major victory as this took away the plaintiff's ability to collect attorney fees if the lawsuit were to not end in my favor. We never did end up going to trial but I am positive we would have prevailed as David was in my opinion the better lawyer and our claims were stronger. Would I use David again, in a heart beat and without a doubt.
