I took on a very serious DUI case. 4th offense, with suspended license, on probation for three priors and two suspended license cases. I took the case 3/4th the way though. The prior attorney totally s ... crewed up the case and when I came onto the case, client was facing 4 years 4 months. The day I took the case, the judge intended to max the client on the probation violations and remand him into custody that day for 3 years, plus the 2 years for the DUI. I 170.6 the judge, got him out of that courtroom and out of the time for the violations. Then i got him in to rehab. The new judge didn't want to undercut the old judge but i prolonged and prolonged the case till ultimately, the client got credit for time served in residential. Had my client began rehab when I told him, he would have served 100% of his sentence in rehab, however, he delayed and ended up having to do 70 days in jail. That's 4 years reduced to 70 days.
