Client had a suspended license due to an DMV Admin Per Se loss due to a DUI arrest. Client’s case was in the middle of a internal DMV appeal. Due to a defective recording of the DMV hearing, the DMV ... Hearing Officer called me and requested the hearing be re-opened due to the fact the internal appeal could not be completed without the fully recorded proceeding. Informally, I requested the Hearing Officer Set Aside the suspension due to the client’s blood alcohol level being a .08% as well as in the interest of the DMV’s time, and prejudice to the client for having to pay an expert for additional testimony. Rather then reset the matter as she initially called for, she said she’d review the matter. Days later the Hearing Officer Set Aside the suspension due to “failing to resetting the hearing date in a timely matter.” Case Set Aside, Suspension Overturned.
