This case was a grandparent visitation case, which are extremely difficult to accomplish because of very strict statutory language (ORS 109.119), and a dearth of supporting case law. Mr. Corbett and I did feel, given the circumstances of the case, that we had strong equity facts to allow a specific parenting time schedule with a grandchild. The court clearly relied on the law, not the facts, in ruling against us. I am sorry that Mr. Corbett feels the way he does, though I have not heard from Mr. Corbett for three years. All other attorneys involved, including the child’s attorney, agreed that no individual was prejudiced or harmed by the conduct. The Oregon State Bar recognized that Robert’s conduct was not motivated by greed or self-interest and was simply a mistake.”
