Defendant who was on probation and had priors and class A license arrested by CHP and BA was .24. We used a necessity and or duress defense in that D would not have driven if he had not reasonably bel ... ieved he had to to stay out of a forest fire he believed had restarted near his home in the foothills. I got help from psycologist and investigator...lots of motions and diagrams and testimony re reasonableness of belief under the circumstances. He got time served 1/2 day for drunk in public and dui and .08 and violations of probation dismissed. Great client ..had jury appeal.

Many motions and contested DMV with inexperienced officer who didn ... ot follow the correc proceedure nor give the correct admonishments paid of for this client big time. Nice client. Officer inexperienced and unprepared. The case began as a refusal with forced BA.. D got terminal sentence . no probation and fine only. Refusal not pursued.

Defedant was allegedly weaving but I had done a 35 defendant Pitchess motion on the arresting officer (a motion to get the cops personel file)that probably accounted for the fact he was "taken off the ... street" the day after the motion was served on the Chief of police, City Attorney, Court and copy given to the local Media. Case actually involved cops staking out a bar and I knew they were and proved they waited for people to get into their cars then invented cause to pull them over. I cited over 35 instances of bad acts by this cop and his partner from different cases. My investigator interview more than 60 arrestees after I placed an add in the local paper asking people with complaints re Chico police to contact my office.
