The lawyer doesn't represent the insurance company. S/he is independent counsel representing the insured, even though fees are paid by the insurer....

Your insurance company will only cover this if you notify them of the lawsuit. Send a copy of the complaint to the adjuster immediately.

No. The litigation privilege protects litigants from future lawsuits. You cannot sue someone for taking legal action against you.

License status is irrelevant. Submit the claim to the other driver's insurance company. If they won't pay, sue in small claims court.
