Replied last February 02, 2012I think the issues arose more from insurance coverage rather than a dispute over the construction defects. I believe the defects were clear but whether it was covered by the contractor's insurance policy was the larger issue. It is common for insurance carriers to defend their insured with a "reservation of rights" in terms of indemnifying (providing payment) on a particular claim. Testing the coverage creates a risk both for the Plaintiff and the insurance carrier. Settlement alleviates the risk for both sides and often is the best result for all involved.
