What a nightmare. I was dismissed from a nursing program for a learning disability and discrimination. How I found Mr. Rapaport I cant recall. He said he would file a complaint with the Dept. of Education which needed to be filed within 6 months. When I asked him why he didnt file it he said I could ...do it. Basically he forgot and missed the deadline. He waited until the last minute and files my claim for damages. We got a response from the opposing counsel. The opposed our claim and even stated that our claim was not only wrong but that the law that Mr. Rapaport claimed was flawed. Mr. Rapaport said he needed to make the changes that they suggested. I thought this very strange so I asked a friend who's been a lawyer for 20 years and has argued on the 9th circuit court of appeals. When he looked at our complaint he said that my lawyer so poorly wrote the claim that it was "fundamentally flawed." I contacted another lawyer after Mr. Rapaport said he was making theses changes 6 months later (waiting for the last minute). This lawyer who actually specialized in Education law brought to my attention "sanctions" had been filed against us for failure to respond. Mr. Rapports response for his delay was that they switched offices and didn't get their request. This was a lie because Mr. Rapaport told me he needed to correct his flawed complaint but told opposing counsel he never got there request. In fact, they still had the old office with same address.
When looking at my complaint one day and the interrogatories I noticed it referred to me as "she." When I asked Mr. Rapaport about this he said he cut and paste from a case that was very similar and forgot to switch "she" to "he." Quality work product. I'm sure opposing counsel took us real serious. LOL. I found out that Mr. Rapaport had lied and only been a lawyer for 3 years when he took my case, hadn't tried any cases and in fact NEVER, EVER had an Educational law case. It was now almost 2 years and nothing was done. I was waiting on my career to get back into the program for nursing. I called Mr. Rapaport who had me on speaker with his partner Nilesh Choudhary. I used to be a paralegal for 9 years and was familiar with some of the motions and processes. So I told Mr. Rapaort to file a "Motion for Order Shortening Time." He said he didn't know if we could since we were the moving party. I asked him, "what do you mean you don't know...your the lawyer Joel." I confirmed this my lawyer friend of 25 years of experience. I was tired of Joel Rapaport lying to me about sanctions, not knowing what he could do, etc. I realized that Joel's partner, Nilesh Choudhary gave this to Mr. Rapaort to practice on.
Mr. Rapaport and his partner Nilesh wasted 2 years on a case they had no experience in handling. I eventually fired them and hired a law firm that had a great reputation. They had this case resolved in 3 months. When Joel Rapaport brought my files into my new counsel, he literally brought them in a shoe box. My new lawyer organized them, put them in files and tabbed them accordingly. Don't ever hire Mr. Rapaport. Its one thing not knowing what you are doing. Its another thing lying and being unethical to you client. It was a very hard experience getting dismissed wrongfully from school and then to hire a lawyer that's supposed to help you, only to have them lie and fumble around with your case was like pouring salt on the wound.
