Mr. Tuitavuki did more than defend me. He helped me become the man I am today, and saved my marriage. I was charged with my 3rd DUI, no license, no insurance, violation of probation, FTA's on the 1st two DUI's, and already owed 9 months in county from previous cases that Mr. Tuitavuki had not def...ended me on when my wife hired him. She told him despite my idiotic history, I was a good person who was drinking, doing drugs, and lost. He asked her if she was looking at divorce...she said maybe! Tim said to her let me meet him and speak to him first. I met with Tim a couple days later, truly believing I was being set up for an intervention but wasn't the case. Tim got through to me. Did I mention my wife hadn't paid him a dime yet! I listened to Tim's advice and did what he told me to do. We retained Mr. Tuitavuki and started the process. I had warrants for my previous dui's, probation violations, and already owed 9 months in jail from a previous conviction. Tim set court dates for my warrants, but did let me know I may be going to jail. He was able to convince the judge not to take me into custody, and rolled all of my files/cases into one so we could address all issues at once every court date. I had made them take blood on my 3rd DUI. Mr. Tuitavuki strategically put my case off for several months while waiting for the right time, with the right DA, and the right judge before bringing it back to calendar. Genius! When Tim decided it was the perfect time to present my cases we were in court fast! Tim listened to the long list of charges and history on me from the DA and my blood alcohol was 1.9 and was ran twice to be certain. Tim simply asked to re-test my blood evidence. They had to agree to send a thrid party lab my blood, and put my case over for two weeks. When we came back the judge asked Tim...do you have the lab results? Tim replied no your honor, the DA's office hadn't sent it to the lab. The judge asked why, and the DA said...we tested Mr. F's blood two times to make sure there was no question of guilt so there wasn't enough blood left for any additional testing! Mr. Tuitavuki immediately responded with...it is my clients constitutional right to have his blood retested by an approved third part lab, and because we were denied that right, I move for an immediate dismissal of all charges against Mr. F. Now keep in mind I already owed 9 months in jail from previous cases, but Tim very strategically scheduled my cases to be heard with this DA on purpose because he was fairly new and didn't know my case at all. Tim asked that I be dismissed of any and all jail time, and probation! The DA was upset and agreed. The judge knew exactly what Tim had done here, and asked the DA again...so you agree to dismiss all jail time and probation against Mr. F? The DA was visibly upset and said yes! The Judge said ok. Then he said to the DA congratulations...you just made Mr. F's year as you just dismissed probation he has owed for years from his previous cases, and 9 months of jail time already owed from previous convictions, as well as ruined your indisputable blood evidence for a third DUI conviction against Mr. F. I am not proud of my history with drinking and driving. Or my being irresponsible and just blowing off ever court date and jail time owed. I have cleaned up my life, and after not having a driver's license for over 20 years...I finally received a full-non restricted driver's license in 2014! My wife and I are very good friends with Mr. Tuitavuki to this day and now I refer him to every friend and family member I have with confidence he will do more for them than any other attorney could ever Do! Tim handled my parents guardianship case for my father. I hired Tim to handle my daughter's emergency child custody case where he was able to get the order signed by a judge the same day I hired him!
