Without breaching any attorney-client privilege, I must refute the majority of your statements. There was no definitive statement by CPS that the claims against you were false or malicious; indeed, you signed a safety plan with CPS. The failed drug test was not enough of a reason to file a Request for Order for Emergency Custody. As I explained numerous times, there must be more evidence to give the Court that he is unfit to care for his own child. You repeatedly said he was a wonderful father and would never hurt his child. Therefore, we had no basis on which to file for emergency custody. Until a Court issues an Order for custody, both parents have an equal right to their child. As such, he had he right to deny you visitation, just as you could have done with him. The papers that I prepared and you signed were the Request for Order for Move Away and accompanying Declaration. Those were filed with the Court and served on opposing counsel. I heartily dispute that the Mediator or Judge made the statements that you attribute to them. We only met with the mediator once. At that time, you and the father entered into a custody and visitation agreement. The Judge was a female, not a male. The opposing attorney did not state to the Court that I had failed to get back to her on rescheduling anything. Not once did I ever, nor would I ever, advise you to violate a court order. In fact, I advised you of the Order and stated the possible consequences for failing to abide by the Order. I went out of my way to help you. Our agreement was for a specified number of hours of my time. You called, emailed, and texted on an almost daily basis - using all of your contracted time within the first few weeks. By the time we went to the first court date, you had used almost all of the time that was called for in our retainer agreement, yet I continued as your attorney. Finally, at the last court appearance in late February, you and the father entered into an agreement and all future court dates were vacated. I spent well over 20 hours on your case and provided you with a discount of over 60% in legal fees and costs. This discount was given in an attempt to make this process go as smoothly as possible for you due to your lack of income and no visible means of financial support. I am sorry that you believe that I did not provide satisfactory service, but I strongly believe that I exceeded the bounds of what another attorney would have provided, and certainly for a much lower rate.
