Samuel Joseph Giammona

Sam Giammona has been practicing law since 1988.  A native of San Jose, Mr. Giammona graduated from Bellarmine College Preparatory in 1980.  After earning a Bachelor of Arts degree from Loyola Marymount University in 1984, (cum laude) he went on to graduate from Santa Clara University School of Law in 1987.  Mr. Giammona began his career while clerking for the Santa Clara County Office of the Public Defender during law school. Following a brief stint in the Riverside County DA’s office, he was sworn as a Deputy District Attorney in Santa Clara County in 1989 and worked in that office for almost 27 years, prosecuting a wide range of cases from simple drug cases to homicides.   

 

While at the District Attorney’s Office, Mr. Giammona became an expert on search and seizure law, drafting hundreds of search warrants and wiretaps.  In doing so, he also developed expertise in the law of confidential informants, bail motions, quashing warrants, traversing warrants and warrantless searches.   He spent over five years prosecuting major drug traffickers on a wide variety of narcotics cases, including possession for sale, transportation and manufacturing. He successfully prosecuted a significant number of drug labs for methamphetamine and PCP.

 

Additionally, Mr. Giammona dealt with individuals who suffered from addiction and alcoholism and he developed a reputation for getting treatment to those who needed it most. He worked with drug treatment programs as an alternative to incarceration and helped countless individuals attain and keep their sobriety.  He employed private and court approved programs such as drug diversion and treatment under Proposition 36 to get people started in their treatment.

He also prosecuted countless felony and misdmeanor violations of probation and became very knowledgeable about the calculation of the correct credit for time served.

 

Mr. Giammona successfully handled hundreds of cases involving crimes of violence, including assault, battery, kidnapping, mayhem, weapons charges and great bodily injury.

 

Mr. Giammona also has expertise in domestic violence cases.  He was among the first members of the newly formed Domestic Violence Unit within the District Attorney’s Office in the early 1990’s.  He litigated domestic violence cases, including: assaults, batteries, stalking, assault with a deadly weapon, assault with a firearm, and attempted murder, all with great success.

He also handled fraud cases involving insurance fraud, elder fraud and major fraud.  These intensive “paper cases” involved a significant amount of discovery material and lengthy preparation, including the collection of evidence from subpoenas and search warrants for bank records, telephone records and witness interviews.
