To keep the story short I will focus on the main points of my buying experience. In 2019, I purchased what I thought was my dream car which slowly turned into a nightmare. I figured it was time to look for a sporty sedan that would be fun to drive for years to come. After looking for a few... weeks I found a 2016 BMW M3 posted online from a dealership located in Southern California. An email inquiry was sent to the dealership asking about the car and it's history. A short time later a salesman contacted me regarding the price and the advised me tge car was still available for purchase. After a few emails and text messages the sales person sent me a full video of the car explaining how the car was in perfect condition and had been Certified by the dealerships. "Certified meaning it has going through BMW's rigours and thorough inspection". We set up a date and I drove down to purchase the car. This is where the nighmare began!!! I made the 4hour drive back to Northern California and suprised my wife with my new car. A short time had passed owning the car when the BMW performance muffler developed a crack along the exhause welds. Since the car was still under manufactures warranty, I decided to drive it to the nearest dealership to get replaced. A few hours had passed and it was time to pick up the car. Upon pickup the service manager advised me that the car was in an accident!!!!! He advised me entire rear panel of the car had been replaced! My heart dropped into my stomache. How could this have happened. I was told the car was inspected, cerifited and was not in any accident! On my way home I called the dealership for weeks with no luck. I left messages for the salesrep and the finance manager. No one returned any of my phone calls. I felt defeated and didn't know what to do. Here I am at a crosssroad and didn't know what to do. Here I have the car that was sitting in my garage which had been in an accident and not knowing the extent of the damange. The dealership ghoasted me and I was unable to get ahold of anyone who helped with my car purchase. So, I decided just to trade the car in for something else. I found another vehicle at another BMW dealership the next town over. So, I walked in met a sales rep and went through the purchase process. A short time later the Finance Manger and the Salerep came over with a Carfax report. The report said the car was in a major accident and they advised me that they could not take my car as trade. I stated this is can't be true. I saw the carfax report in the finance managers office and it stated the car had a clean report. ( Later found out the dealership switched the copies with another clean vehicle and did not provide me with a car fax report). I explained to the finance manager what should I do. He advised me to file a claim with BMW USA and Contact a lawyer. This was such a strange thing to hear from a dealership. So, I immediately called BMW USA and filed a claim and now it was time to find an attorney. I emailed several Attorneys explaining what happened and then once contacted me and said they would help as they delt with these cases before. Thank God for Kemnitzer, Barron & Krieg. The dealership forged my signature on documents, swindled me out of almost 1 thousand dollars for an interior fabric warranty and also not providiing me with a copy of the car fax report that I signed which was suppose to be a clearn carfax and Certified Pre Own Checklist.
