Today I received a remarkable result for a U.C. Berkeley student who was arrested for DUI. Client blew four breath tests all registering .09% BAC, which was problematic considering he was only 20 at t ... he time and this was a "zero tolerance" case (i.e. .01% is the standard for guilt). I filed a Motion to Suppress Evidence in Oakland and the District Attorney failed to meet her burden of proof and the criminal case was dismissed. I appeared at the DMV and won the hearing obtaining a "set aside" of what would have been a ONE YEAR suspension. All in all, client received NO PUNISHMENT other than the fee! Again, another "home run" in DUI defense.

License actually suspended for thirty days and restricted for 10 months due to the long DUI program.

Difficult case in that client resided in Texas and needed a resolu ... tion that would not require a return to California. Settled this case case enhancement stricken and sentenced by Judge Koh to three years of informal probation, fines and fees, DUI school stayed only unless client moved to California, and 40 hours of community service in lieu of jail or SWAP. Case took numerous appearances and a lot of work, but finally got the result the client needed in the end. California license suspended for six months pursuant to conviction.
