Today I settled high BAC first offense DUI case in Department 13 at the San Francisco Hall of Justice at 850 Bryant Street. Client was driving home from work in North Beach when she was stopped by the ... US Park Police for illegally backing up on a highway and driving into a closed buffer lane. Client subsequently provided two .17% breath samples and was charged with DUI and the high BAC special enhancement. Case settled for dismissal of special enhancement, three years of informal probation, four days of SWAP, fine of $1,750 and a THREE MONTH DUI SCHOOL, which is significant because the ill informed DA actually wanted a six or nine month program. License suspended for thirty days and restricted by DMV for five months.
