12% breath test case with .12% PAS settled today in Redwood City, San Mateo County. Case involved allegation of illegal u-turn in a business district. Client actually took left turn into angled parki ... ng stall, reveresed and turned around. I filed and argued a Motion to Suppress Evidence which was denied. Subsequently appealed that decision which was regrettably affirmed. Client recived minimal sentence for a CVC 23152(b) conviction and I entered the plea on his behalf so he didn't have to miss any work. Three years probation, 3 month DUI school, $1,700 in fines and two days of weekend work through the SWAP program. Kept DMV case alive while handling the file for more than six months and made an agreement with the hearing officer so that client would not have to serve the typically mandatory 30 day "hard" suspension.

Today I settled a first offense DUI case with a refusal allegation in Santa Clara County. My client, an out of state resident, had erroneously refused a chemical test during a DUI investigation outsid ... e of Gilroy while visiting on vacation. After several appearances and much negotiation, I was able to settle the case today for a plea to a DUI with the special allegation dismissed. Client received: credit for time served and no additional jail time or Sheriff's Work Program.; three years informal probation and a fine of $1,750. She will not be required to complete a DUI school as a condition of her probation. Basically, it's a DUI conviction with a fine and the cleint never had to appear in court. I think, a great result.

Client was never required to appear in court or return to California for case. ... High BAC enhancement strickent and client received minimum sentence of three years of probation, fine of $1,600, and Florida DUI school. NO JAIL, SWAP OR COMMUNITY SERVICE. Client's ability to drive in California suspended for six months.

High BAC enhancment was stricken and client received three years of probation, fine of $1,788, ten ... days of SWAP, and a THREE MONTH DUI SCHOOL. A NINE MONTH school is standard in this type of case. License suspended for thirty days and restricted for five months. If nine month DUI school was ordered, restriction would have lasted for ten months.

7/9/2009: In Redwood City, I settled a .09% first offense DUI for a reduced charge of reckless driving ("wet") pursuant to Vehicle Code section 23213.5. DUI charges were dismissed and client rece ... ived reduced sentence of two years of informal probation, fine of $1,221, 12 hour DUI school. NO JAIL, SWAP OR COMMUNITY SERVICE. I later litigated the DMV case in San Francisco before Hearing Officer Emershaw. Presenting expert testimony from Halle Weingarten, we won the hearing and received a "set aside" of the DMV suspension. No suspension, no SR-22 and an excellent result.
