OUTCOME: DUI CHARGES & ENHANCEMENTS DISMISSED for Reckless Driving. 3 years probation; $809 Fine; 9 month DUI School; 25 hours community service; 20 AA meetings; and MADD class

Client was stopped by the San Francisco Police Department for "speeding and reckless driving" on Fell Street after midnight. Client submitted to "field sobriety tests," but refused to take a prelimina ... ry breath test ("PAS"). Once at the station, client also refused a blood test so a warrant was obtained and his blood subsequently take and analyzed with a result of .14% BAC. Today, we successfully settled client's case for a dismissal of all DUI charges and enhancements for a plea to the reduced charge of "Reckless Driving" (Wet). Client sentenced to three years adult probation, 9 month DUI school, 25 hours of community service, 20 AA meetings and attendance in the MADD DUI awareness class. Since this was a "second refusal," client's license suspended by DMV for two years.

Client was a traveling registered nurse who was stopped by the California Highway Patrol for weaving on Highway 101 N/B. After field sobriety tests, client refused the PAS but later submitted to breat ... h tests with results of .12% BAC. Normally, this would surely be a DUI in Marin County, but today we negotiated a reduction to Reckless Driving for a much reduced sentence of one year of probation, fine of $800 and a 12 hour DUI school which was to be completed online.

OUTCOME: ENHANCEMENT DISMISSED & PROBATION GRANTED: 3 Years, Fine $1,900 and 3 Month DUI School

Client was driving home after playing golf in San Francisco when he was stopped by the California Highway Patrol for weaving on the the Golden Gate Bridge. Client complied with investigation but opted ... for a blood test rather than a breath test. IT'S MY OPINION THAT BLOOD TESTS ARE OFTEN HIGHER THAN BREATH. Anyway, the blood came back a .15% BAC thus triggering the "excessive BAC enhancement." Today we resolved the case for a dismissal of that enhancement. Client sentenced to three years of probation, fine of $1,800, and a three month DUI school. NO JAIL OR SWAP.

OUTCOME: NO ACTUAL JAIL: 160 days Electronic Monitoring, 18 Month DUI School, $2769 Fine; 2 Years IID

Client was visiting California from Idaho when he was stopped by the San Jose Police Department because he forgot to turn on the headlights in his rental vehicle. Client had a few drinks, so his BAC c ... ame back a .13 % by blood test. Although only booked for DUI, the District Attorney later learned that he had two active DUI priors from Idaho and another in Texas. As a result, client was charged with a 3rd Offense DUI, almost ensuring that he would spend a significant time in ACTUAL CUSTODY JAIL. We worked this case for two years and in the end, settled it for NO ACTUAL JAIL and client never had to return to California once to appear in his case. INCREDIBLE RESULT. Client sentenced to 5 years informal probation, 160 days house arrest/electronic monitoring, 18 month DUI school (online), 2 years IID and fine of $2769. License revoked in California for 3 years. This "no jail" result allowed client to keep his job and an opportunity to turn this around and never do it again.

OUTCOME: Probation Granted: 4 Years, $2,000 fine, 18 Month DUI School, 40 Days Weekend Work, 1 Year IID and NO ACTUAL JAIL.

Client had previously been convicted of DUI in San Francisco and was currently on a grant of diversion for a drug case in Palo Alto when she was driving and got a flat tire on N/B 85 at Camden. The CH ... P arrived and client submitted to two PAS tests with results of .24% and .28% BAC. Client was arrested and later submitted to two breath tests at the station with results of .27% and .29% BAC. Today we settled this tough case for NO ACTUAL JAIL. Client sentenced to four years probation, fine of $2,000, 40 days of Weekend Work and one year of an ignition interlock device ("IID") and the 18 month DUI School.

OUTCOME: JUDICIAL DIVERSION GRANTED: 20 HOURS COMMUNITY SERVICE & 10 AA MEETINGS FOR COMPLETE DISMISSAL OF ALL CHARGES

Client was a resident of Washington State and a Seattle Seahawks fan who became inebriated while attending a playoff football game against the San Francisco 49ers. A squadron of armed police arrived a ... t her location in the stadium and very roughly removed her, ultimately binding her in a "WRAP" device because she allegedly spit at them. This case involved all male officers and client alleged that they touched her inappropriately which caused her to retaliate. Coincidently, the officers body worn cameras were simultaneously not functioning. Client charged with two counts of assault on a peace officer and DA refused anything but a plea of guilty. Undaunted, we fought for nearly two years and today were able to take advantage of a change in the law getting the judge to grant "judicial diversion." As a result, client ordered to complete 20 hours of community service and attend 10 AA meetings and stay arrest free for 3 months at which time all charges will be dismissed and sealed.

San Mateo County (Redwood City) .16% BAC 1st Offense DUI w/ Speed Enhancement

OUTCOME: ENHANCEMENTS DISMISSED & NO JAIL/SWAP; 3 years probation, $1900 Fine and 3 Month DUI School

Client was stopped by the California Highway Patrol ("CHP) for speeding on I-280. The officer alleged client's speed was 100 MPH. Client subsequently investigated for DUI and blew .16% BAC on the PAS ... test. At the station, Client's breath tests were .14% and .13% BAC. Today at the pretrial conference, we resolved the case for a plea to a generic DUI charge with ALL ENHANCEMENTS DISMISSED. Client was sentenced to three years informal probation; fine of $1,900; and a three month DUI school with NO ADDITIONAL JAIL OR SWAP. Although it would have been awesome to get the DUI reduced, it was extremely unlikely and this was a great DUI result for San Mateo County.

Client was involved in a property damage only motor vehicle collision which was investigated by the San Mateo Police Department who found empty cans of “hard seltzer” inside her car. Client submitted ... to two PAS tests with results of .17% and .16% BAC. After her arrest, client completed two more breath tests which came back at .15% BAC. While at the station, police alleged that client was unruly and assaulted one of the officers. Although an ugly case, today we finally settled the matter for plea to DUI and dismissal of the high BAC enhancement and the assault charges. Client sentenced to 3 years probation, fine of $1,900 and a three month DUI School. NO JAIL, SWAP OR COMMUNITY SERVICE.

Client was originally charged with misdemeanors for "stalking" and violating a court restraining order stemming from a bad break up with his girlfriend. Client was not a US citizen, so it was crucial ... that I settle the original case for a "safe" disposition, which we accomplished with a plea to "disturbing the peace." Today we finalized the case in that since Client completed his one year of probation successfully so all charges were dismissed by way of expungement petition which I filed and argued on his behalf. OUTCOME: ALL CHARGES DISMISSED AND RECORDS SEALED PER SUCCESSFUL DIVERSION

Client was stopped by the CHP for speeding, approximately 85 mph on US 101 South a 65 mph zone and was ultimately arrested for DUI. Client refused PAS and submitted to blood test with result of .10% B ... AC. Client was employed with auto dealership and would be terminated if convicted of DUI. Today, we were one of the last DUI defendants for long time, to have completed a diversion program which consisted of a DUI school and community service for six months. Client did so and as a result, all charges were dismissed this morning and records of his arrest ordered sealed.
