Client was in a real jam. Having been previously convicted of DUI and planning on moving out of state, Client was found by the CHP in her parked vehicle outside of a liquor store in a heavily intoxica ... ted state. After her arrest for DUI, client submitted to a blood test which returned a BAC result of .22%. Ideally, I was hoping to resolve this case without client being ordered to return to California. Today, however, I did one better. Upon learning of misconduct by the arresting CHP officer, the district attorney agreed to DISMISS ALL CHARGES.

Client was stopped by the California Highway Patrol ("CHP") after he was observed weaving and driving erratically on I-880. Client performed poorly on field sobriety tests and submitted to two PAS bre ... ath tests with results of .12% and .11%. Client was then arrested for DUI and later submitted to a blood test with result of .10% BAC. Today, we successfully resolved clients case for a reduction to "reckless driving" and no admission of his prior offense. Client sentenced to one year of probation, fine of $833 and a 12 hour DUI School.

Client was arrested by the Piedmont Police Department after he was reported to have collided with a parked car in front of his apartment. Police arrived and conducted DUI investigation. Client refuse ... d PAS and submitted to a blood test which returned result of .23% BAC thus qualifying him for the high BAC enhancement as well. Today, I successfully settled this case for a dismissal of all DUI charges and plea to "reckless driving" ("Wet"). Client received heavily reduced sentence of one year probation, fine of $1,923 and 9 Month DUI School. The reduction was critical because I would later obtain a "set aside" of client's DMV suspension hearing so client suffered NO ACTUAL LICENSE SUSPENSION & NO SR22.

Client had a prior DUI conviction when he called the SSF Police about a suspicious vehicle he observed in his neighborhood. Upon arrival, the police immediately suspected client of being under the inf ... luence of Meth and a surreptitious DUI investigation ensued. Client refused to cooperate and was later charged with a "refusal" allegation as well. This case began with a win or "set aside" at the DMV hearing and today the criminal case was resolved after a week long jury trial. The jury deliberated just over an hour before rendering a verdict of "not guilty". Client avoided conviction and license suspension for all charges: a total win.

Client was involved in a road rage incident in the parking lot of a shopping chain when he allegedly punched another driver in the face and kicked the side of his car multiple times. The San Mateo Cou ... nty Sheriff investigated and arrested client for Assault and Vandalism. This case lasted a long time, but today I settled the case for a DISMISSAL of the assault charges and a plea to vandalism. Client received sentence of two days of community service (SWAP), one year of informal probation and a fine of $220. Victim claimed restitution in the amount of $3,248 which was granted.

Client was stopped by the CHP for weaving and officers detected the "odor of alcohol" leading them to request a PAS breath test which returned a result of .11% BAC. Client was then arrested for DUI an ... d later submitted to two breath tests with results of .09% BAC. Today, we settled this case for a dismissal of all DUI charges in exchange for a plea to the reduced misdemeanor charge of "Reckless Driving." Client received a sentence of one year of informal court probation and was ordered to complete a 12 hour DUI school. All fines and fees (approximately $2,000) were waived by the court and client not ordered to complete any community service or SWAP.

Client made an unfortunate mistake of approaching the CHP and asking for driving directions after consuming a significant amount of alcohol. Indeed, the police noticed a number of "White Claws" on the ... floorboard of the vehicle. Client submitted to breath tests of .13% and .14% BAC and was subsequently charged with DUI. Today we settled the case for a DUI conviction, but no jail or SWAP and a significantly reduced fine which saved the client over $1,600.

OUTCOME: REFUSAL ENHANCEMENT DISMISSED & Probation Granted: 3 years, $1400 fine and 3 month DUI school, NO JAIL, SWAP OR COMMUNITY SERVICE.

Client veered off the road and collided with a sign. The California Highway Patrol arrived sometime later and when they tried to conduct a DUI investigation, client refused to cooperate and remained s ... ilent throughout. While this was a great strategy, it went south when he “refused” to submit to any chemical test. Client was arrested for DUI and the CHP obtained a warrant to obtain his blood which when tested showed a .16% BAC hours after the time of driving. Today, we reluctantly settled this case for a plea to DUI with the refusal enhancement dismissed. Client sentenced to three years informal court probation, fine of $1,400 and a three (3) month DUI school. Client’s license to be suspended by DMV for one year due to the refusal.
