Client was found asleep in her car in the afternoon while waiting in a fast food drive thru. The Redwood City Highway Patrol conducted a cursory DUI investigation and client refused to take the PAS br ... eath test. At the station, however, client did submit to two breath tests both with the same high result, .19% BAC. Client charged with second offense DUI because of a 2014 prior offense. We concluded the case today for a fair sentence: three years informal probation, fine of $1,879, 18 Month DUI School and after credits, 9 actual days of weekend work in lieu of jail. License suspended for two years. NO IID ORDERED BY COURT.

Client collided with white line delineators at the exit of US 101 and Middlefield Road. Although there was little damage, the collision was observed by California Highway Patrol Officers (CHP) who imm ... ediately began an investigation. Client refused the PAS breath test and ultimately agreed to a blood test which returned a result of .23% BAC. This was client's second DUI in five years and the prior was also in Santa Clara County. Strangely enough, I was able to actually negotiated a BETTER result today for the present case than her other attorney who represented her on her first DUI. Client received the following sentence: 4 years court probation, $2,359 fine, 18 month DUI school, 1 year IID and 18 days of Weekend Work in lieu of actual custody. Pretty good considering her previous DUI attorney negotiated a sentence of 35 days Weekend Work on her first offense. Who you hire really matters!

Client was stopped by the California Highway Patrol in Southbound I-280 after a report by a concerned citizen of weaving and erratic driving. Client submitted to a PAS breath test with results of .22% ... BAC and a later breath test at the station of .21% BAC. Client had previously suffered a DUI conviction in 2014 thus making this his "second offense." Today we settled the case for a non jail resolution: three years informal court probation, fine of $239, 20 days of weekend work/SWAP in lieu of jail, 18 month DUI school and one year of an ignition interlock device ("IID"). Client's license suspended, however, he is now eligible for a "restricted license."

Client was involved in a rear end collision in San Jose which resulted in some injuries to the victims. Client submitted to a breath test with results of .20% BAC. Client initially charged with FELO ... NY DUI because of the injuries. Today, I settled client's criminal case for a plea to MISDEMEANOR non-injury DUI and admission of the high BAC enhancement. Although I would have liked to push for a better result, strategy dictated that we settle the case ASAP as a non-injury misdemeanor DUI. Client sentenced to 3 years informal probation, 9 month DUI school, 4 actual days of weekend work and a fine of $1,959. License restricted for 10 months.

OUTCOME: FELONY CHARGES DISMISSED; Probation Granted: 3 Years, Fine $1,985, 3 Month DUI School, 4 Days SWAP

Client was a young man who drank way too much and crashed into another car while on his way to a party in South San Francisco. SSF Police were able to follow his vehicle's fluid trail and confronted h ... im at the party. Client was argumentative with the police who responded by tackling him to the ground. While on the ground, Client shouted numerous obscenities to the police who responded by charging him with a FELONY under Penal Code Section 69, "attempt to deter executive officer's by force or threat." As a topper, Client "refused" the chemical test so a warrant was issued to take his blood which had a result of .17% BAC. The DA refused to settle the case without the Felony, so I had to argue the matter before the court at the preliminary hearing. The judge then reduced the felony to a misdemeanor. Today, after two years, I was able to settle the case for a misdemeanor DUI and "hit and run" charges for 3 years probation, 4 days of SWAP, fine of $1,985 and 3 month DUI school. As bad as this client acted, I was determined that he not be convicted a felon and today that hard work paid off. I almost forgot, I won the "refusal" issue at the DMV to save the client from a one year suspension.

Client was stopped for speeding and weaving by the Daly City Police Department. The police smelled alcohol and client submitted to field sobriety tests including a PAS test of .08% and .10% BAC. The ... low tests were countermanded by a later blood test which resulted in a .14% BAC, which made things substantially more complicated. After much wrangling, I was able to get the District Attorney to agree to dismiss the DUI charges for a reduction to "Reckless Driving." As a result, Client received a much reduced sentence of one (1) year of court probation, fine of $1,556 and a 3 month DUI school.
