OUTCOME: Defense Verdict After Trial & Appeal.
Highly contested case. Hotly contested legal theories among different lawyers. Five prior defense firms had already been on the case. Voluminous files were referred 1 week before trial after prior defe...nse law firm was dismissed 1 week before trial. Independent Medical Examiner's (IME's) deposition set 2 days before trial. Out of all the well-known and prestigious California defense law firms at client's disposal, MKERT was selected due to its reputation as trial lawyers when absolutely nothing but the best will do. Client had indicated that this was a catastrophic claim and that the litigation was absolutely high stakes with a lot of important people watching the case with heightened expectations, and heightened concerns about liability. MKERT took over case 1 week before trial, took IME's deposition, and showed inconsistencies in IME's analysis of claim through rigorous cross-examination. Case went to trial where trial judge issued adverse verdict against defendants. Defendants filed a successful appeal detailing why the trial judge had erred, and why the court of appeal should reverse the trial court's adverse decision. The Appeals Court agreed with defendants, heavily relying upon the cross-examination of the IME two days earlier; and, 1 year later, defendants prevailed on all counts subsequent to appeal with the following unequivocal and final result: $2 million plus liability avoided by defendants. On January 30, 2014, the Second Appellate District, Division Seven, issued an Order Denying Plaintiff's Petition for Writ of Review.
