People v. Whiteaker (Jury Trial -- Assault & Battery)

OUTCOME: Jury Trial -- 2 counts dismissed, one count acquitted, one count hung

Client was charged with 4 counts of assault and battery. Facts: Client was intoxicated and got into a fight with his 16-year old stepson. The boy's father entered the house and saw the Client on top o ... f the boy, choking him. When the father tried to defend his son, the Client punched the father in the face hard enough to knock a tooth loose. Client was charged with two counts of assault & battery against the step-son and an additional two counts of assault & battery against the father. Original Offer -- DA wanted Client to plead guilty to one count of battery with 3 years probation, search & seizure conditions, 5 days of Caltrans, 30 Alcoholic Anonymous classes, 10 Anger Management classes, $4400 in restitution and a protective order for the father. Jury Trial -- After the People finished their case, the judge granted our motion to dismiss all the assault counts. After we rested, the jury came back with not guilty one of the battery counts and hung on the other battery count. Final Result -- The DA gave us a new deal. Client pled guilty to one count of disturbing the peace with 3 years probation but an opportunity to terminate probation after one year assuming completion of 10 Alcoholic Anonymous classes and 10 Anger Management classes. No search & seizure, no Caltrans, no restitution, no protective order.

Client was previously convicted of a DUI. Then client convicted of felony statutory rape while on probation for the DUI. Client hired our office to dismiss his convictions pursuant to Penal Code sect ... ion 1203.4. We successfully reduced his felony statutory rape to a misdemeanor and dismissed the conviction. We then successfully dismissed his DUI conviction over the DA’s opposition.

Client involved in verbal altercation with supervisor and threatened to “choke him out”. Supervisor reported matter to police who interviewed the client. Client then retained our office to represent ... him. We then contacted the prosecutor's office and arranged a meeting with them prior to the filing of charges.

OUTCOME: Client avoids jail and deportation

Client sold burned copy of Rosetta Stone to an undercover police officer. Police discovered thousands of burned movies and software in his house. Client was charged with 27 felony counts of possessing ... counterfeit property. Client was a permanent resident and any prison time would have resulted in deportation. Client also preferred not to spend time in custody. Initial offer was 16 months county prison, split sentence with 220 days custody. Second offer was 16 months county prison, split sentence with 90 days custody. Final result was 3 years probation with 180 days jail to be served as community labor; immigration safe plea.

Client previously convicted of felony burglary and a 3rd DUI in 2008. He then violated probation with a conviction for unlawful weapon possession in 2009. Client petitioned to have his felony reduced ... to a misdemeanor and his case expunged in September 2012 and his petition was denied. He hired our office to re-petition the court six months later. After a contested hearing where the DA objected to our petition, we convinced the judge to grant the petition. Client’s felony was reduced to a misdemeanor and all his convictions were then dismissed. Client posted a review in our Client Review section -- from "Michael" on 04.09.13.
