David I. Berman

Attorney Berman defended my sister Cheri at her Motion for a New Trial back in 1996. Our family thought he did everything he could to show how a trial lawyer misrepresented her at her murder trial. Being Cheri's main alibi witness, i know first hand she's innocent. But unfortunately, as Cheri was wit...h family members at the time of the crime (instead of what? Strangers?), it's convenient for judges to call family "classic alibi witnesses". We had reciepts showing Cheri was with us for a 3 day period corroborateing Cheri's whereabouts, but the court never asked to see or examine them. They prefered taking the word of the trial lawyer (who misrepresented the truth to the judge) over 4 alibi witnesses which Mr. Berman and the prosecutor quesitoned on the stand at the MNT - along with one of previous lawyers (and her champion) atty Steven Wadler who achieved Cheri's O.R. release presious to her trial. He did so by revealing the prosecutor made material misstatements in her arrest warrant and showing that the probable cause used to arrest her was fabricated. Still, when the MNT judge put that atty on the stand, he didn't like it when it cast a bad light on the prosecutor. Long story short, atty Berman did his homework on the case, but it was hard to change a judge's mind when he was the same judge who only heard the prosecutor's side of the story at trial, and bought it hook line and sinker.
