I represented this client and achieved a tremendous result for her given the circumstances. She hired me to sue her former boss, a small business owner, for sexual harassment. Dana Turner only worked for eight days, then quit. I took her case anyway, based on Dana's representations. However, after working on the case for over a year, and spending a ton of time and money pursuing the case, the investigation revealed that there were no corroborating witnesses to any of the supposed conduct. The defendant himself steadfastly denied any conduct as the client claimed. It was a classic he said/she said scenario. Even worse, the defendant had zero assets and rented his residence. The defendant’s business was a financial wreck and losing money. The defendant’s lawyer who was not being paid either, presented a stark choice to my client: either take a small settlement paid over time, or take nothing because the defendant would file bankruptcy and that would be that. When the client was presented with this choice, she chose to take the small settlement paid out over time rather than take nothing. It was a good choice. The defendant ended up making all of the monthly payments over time, and the client was paid in full. It is upsetting to hear this disgruntled client complain after the fact. All of this was explained to the client in detail, and it was the client’s choice. It is disappointing to say the least that this client, who did get a small settlement, into the 4 figures despite the circumstances, chooses to complain about not getting rich, instead of thanking me for winning a case for her that was impossible to win. I once sued a chiropractor for sexually harassing an 18 year old office assistant. The day before I was set to ask questions of the doctor under oath at his deposition, the doctor filed bankruptcy. The sexual harassment lawsuit was stayed, and we could do nothing but await the outcome of the bankruptcy case. The bankruptcy judge found in favor of the chiropractor and discharged all of his debts, including throwing out the sexual harassment lawsuit, leaving my client with nothing, and me with a pile of bills I incurred in prosecuting my client’s case. Because of that experience, which I shared in detail to Dana, she correctly understood the significance of trying to sue a defendant with no money, no assets, and no ability to pay. She understood that spending more time and money pursuing a case where the defendant had no ability to pay was a losing proposition. She knew that if she wanted to pay the out of pocket costs to keep fighting the lawsuit, she could have done so. She knew that throwing even more money down the drain to pursue a judgment against a judgment-proof debtor was not the correct decision. She did not have to accept the settlement, it was her own personal choice. And, the choice she made to settle the lawsuit was an excellent choice indeed. Do not take this lone, disgruntled client’s story as an example. Rather, read the rest of my dozens and dozens of other clients’ glowing reviews, and compare for yourself whether this lone client is telling it accurately or not. See for yourself how this client, even though she won and got paid, is unlike all the other satisfied clients of mine. It is most unfortunate for Dana that she is disappointed in my services when her real disappointment is with the defendant who had no money or assets and could never, ever be able to make Dana rich from her case.
