We applied for an I-601A provisional waiver for a client who had entered and lived in the US illegally. He wanted a green card to be able to live here legally with his US citizen wife and children. T ... he Problem - 1) his illegal entry and stay in the US., prevents him from getting a green card in the US even if he has a US citizen spouse. 2) He can only get a green card at a US Consulate abroad (Consular Processing) 3) However, if he travels abroad to a US Consulate, he will face a ten-year ban from the US. Solution – one we identified the problem, explained to him how we could solve it, and worked on it in steps. 2) We applied for a provisional waiver with the US Citizenship and Immigration Service (USCIS) showing the hardship his US citizen wife would suffer because of the ban 3) We encouraged the USCIS to waive the ten-year Unlawful Presence bar so he can travel abroad for his green card. Our client was delighted when his provisional stateside waiver was approved. This means that he can now travel to get his green card without being separated from his family and job for many years.

According to this notice, it means that the USCIS has decided that we have shown an initial case for VAWA classification. This great because the prima facie determination is a first and positive step in the I-360 petition process and allows her certain benefits including a work permit. Six weeks after the Prima Facie Determination Notice our client received her work permit. With a work permit, she can now support herself while the USCIS continues to process her application. Our client says that this news came at the best time.
