Marc A Holmquist

Marc Holmquist is a litigator who has focused his career on employment litigation and counseling.  Before establishing Holmquist Law, he was a Partner in the Employment Law department of Gordon & Rees, a large national law firm, where he represented business clients in all aspects of civil litigation in state and federal courts throughout California.   His experience there included counseling on hiring practices, terminations (including separation agreements), discipline, reductions in force, workplace investigations, drafting and revising industry-specific employee handbooks and other written policies, contracts, wage and hour compliance, sexual harassment training, and litigation avoidance practices.  His litigation practice included claims for wrongful termination, harassment, whistleblower retaliation, wage and hour, PAGA, and discrimination based on protected characteristics including age, race, national origin, disability, sex, gender, pregnancy, and sexual orientation. He has also litigated matters involving claims for breach of contract, fraud, defamation, and other torts.  His successes include:

• Obtained summary adjudication of claims for age discrimination and wrongful termination.

• Obtained judgment in client's favor after trial of plaintiff's claims for breach of implied employment contract.

• Obtained summary adjudication of claims for violations of the Private Attorney General Act ("PAGA") and violations of Labor Code 226(a).

• Obtained summary adjudication of claims for harassment and discrimination in violation of the Fair Employment and Housing Act ("FEHA").

• Obtained pre-trial dismissal of cause of action for unfair competition alleging the misclassification of plaintiff as an exempt creative professional; after defendant moved for summary judgment, plaintiff dismissed the cause of action with prejudice in exchange for a waiver of costs.

• Obtained pre-trial dismissal of entire action in federal district court alleging violations of the Fair Employment and Housing Act, federal fair housing laws, and related tort claims.

• Obtained dismissal of harassment and discrimination claims before the Department of Fair Employment and Housing.

• Obtained dismissal of retaliation claim before the Department of Labor Standards Enforcement
