JJ was arrested for a felony DUI causing injury and having a prior DUI. A chemical test was administered and JJ’s test results were 0.12 and 0.12. The prosecutor was looking to give JJ substantial jail as well as other second DUI conditions.

The police were called to the scene of a domestic dispute by concerned neighbors. When they arrived they found a couple who had been arguing and fighting. No real investigation was done to determine who what the aggressor was or what had happened to Denise, first.
