Mr. A and his girlfriend had run away from a party. They both jumped in the car, where Mr. A's girlfriend was the driver. When they were on the freeway, the car ran out of gas. They were stopped on the... shoulder and both sitting in the back seat. The CHP then drove up behind them and did a "welfare" check. Immediately following the welfare check, the CHP officer conducted a DUI investigation. Neither party admitted to driving, but because the car was registered to Mr. A, Mr. A was arrested for DUI. On July 9th, 2013, we ran a motion to suppress the evidence and dismiss the DUI counts against my client. The Judge sided with us, and the DUI charges were dismissed pursuant to PC 1538.5. There was no probable cause to arrest my client on suspicion of DUI.

Client X was at a family function when some unwanted guest arrived. The owner of the house had told Client X to ask the unwanted house guests to leave. Client X got into a verbal argument with the unwa...nted house guests who eventually left. However after the houseguest had left, they tore their clothing and called the police and said Client X had attacked them.
Approximately 14 months had passed since the time of the alleged incident and there was no contact made by the police. One day Client X's wife was at home, when the police had knocked on her door to serve a warrant for Client X's arrest. The issue was, the alleged incident occurred over 14 months ago.
Without having Client X having to go into custody, I was able to recall and quash the warrant in court. I plead not guilty on behalf of the client and requested and was granted an OR release. For our next court date, I filed a Serna Motion, to dismiss my client's case because Client X's speedy trial rights were violated.
Today, the entire case and action against Client X was dismissed. Client X saved $40,000 in bail money and kept his criminal record clean.
Client X is an actual client, however, we have kept his name completely private per their request.

Mr. A was driving his drunk friend back after going to dinner. Mr. A had one drink and felt fine to drive while his friend was heavily intoxicated. He then began to follow Mr. A on the highway, waiting for Mr. A to commit a traffic violation. The officer claimed Mr. A's rear tires went over the solid white lines and pulled him over. Mr. A was then accused of being high on drugs. After that Mr. A, he was requested to perform the FSTs. Mr. A's PAS came back at .09/.08. After months of negotiations with the District Attorney on this case, I was able to have his DUI dismissed!
