After reviewing the case with the District Attorney assigned to handle the case, I was able to dismiss all 3 charged originally filed against Mr. A (VC 23152 (a); VC 23152 (b); VC 14601.1) and securing a lower crime of VC 23103.5 – Wet Reckless.

After finding out his daughter was caught stealing for a third time, Mr. P decided his other forms of discipline were not enough. Previously, Mr. P had counseled his daughter and taken away TV and anot ... her time, held a "trial" in his living room regarding the theft. Seeing that those two times had no impact and his daughter was caught stealing a third time, Mr. P decided that this time physical discipline was in order (which by CA law is legal so long as its reasonable under the circumstances). Along with spanking his daughter with a belt, Mr. P also took his daughter to the store to return the stolen goods as well as taking her to the police station where she was to do a mock booking. After all this, his daughter was to write an essay on why stealing was wrong. The issue the prosecution had with this case was that the victim had bruised as a result of the belt and in their eyes that was wrong. I pleaded the prosecution to give my client diversion as his job was at risk, however they would not give that to him. After a 5 day Jury Trial, Mr. P was found Not Guilty of all charges!
