Mr. S was charged in violation of 2 counts of DUI 3 counts of driving on a suspended license and 1 count of assaulting another person. The events occurred on May 22, 2011. After being beat up by both p ... olice officers and the EMTs, Mr. S was transported to the hospital to be treated for his injuries. Mr. S was never arrested, nor was Mr. S even given a citation letting him know he is being charged with a crime. The City Attorney's office of Long Beach alleged that they did send Mr. S a letter stating he was to appear in court, but Mr. S did not receive the letter. Because of the Prosecutions delay, I decided to file a Serna Motion because of my client's due process right to a speedy trial was being violated. The prosecution fought me the entire way. Today after final oral arguments, the Judge ruled in our favor and dismissed the case.

Mr. P went to a business dinner and had a single beer. On his drive home he looked down at his GPS to see where he was going. Mr. H came in regarding his first DUI. He explained his situation and that his BAC was allegedly .10. Furthermore, he told me he was going 90 MPH in a 45 MPH zone, which gives him a speed enhancement, ... which carries with it a minimum 60 day jail sentence. Mr. H's problem was two fold. If convicted of a DUI he would be forced to install an IID on any vehicle he drove, his problem was that he drove a truck for a living that was owned by the company he worked for. If he was to have that restriction, they would fire him. So Mr. H's job was on the line and he was facing 60 days of county jail. After months of negotiations on the case, I was able to convince the DA to dismiss not only his speed allegation, but also his DUI and Mr. H was sentenced on a wet reckless charge.

Mr. N came to my office shaking! Literally, he was shaking. He had gone to get some day work done and met some people. They offered for him and his wife to come upstairs to his hotel room for some brea ... kfast burritos. When they got up stairs, Mr. N was offered some methamphetamine. All of a sudden the police knock down the door of the motel room and arrest Mr. N and the person who offered the methamphetamine to him. Mr. N was later charged with possession of a controlled substance and possession with the intent to sell. After months of negotiations and going back and forth, I was able to secure a dismissal of the possession with intent to sell and was able to secure Deferred Entry of Judgment on the Possession charge. This way, Mr. N can walk away without any felonies or misdemeanors on his record from this case. He just needs to finish a drug treatment program and this mess can all be behind him!

Ms. W. came into my office panicked about a DUI she had just received. At the time Ms. W came to my office, neither she nor I had the results of her blood test yet, but based on her drinking I did not ... think her BAC could be more than .08, so I told her I would work on everything. Mr. C was sleeping in his car, waiting for the effects of the alcohol he drank that evening to wear off before he began to drive. While sleeping in his car, the CHP conducted a "welfare" check to make ... sure Mr. C was ok. Seeing that he was on Parole, they decided to push the envelope and have him arrested for DUI, even though no one had seen him driving and no one had reported him driving. After careful consideration, I was able to secure a letter from the Long Beach City Attorney's office which rejected his case due to a lack of evidence.
