For 2004 and 2005, you owed IRS over $122,000 for tax years 2004 and 2005. On October 20, 2017, you engaged us to file an Offer In Compromise for you on grounds you could not pay what you owed IRS. You Offered $500 to settle your tax liability. You filled out and signed a financial statement under oath supporting your contention that you could not pay more than $500. On November 14, 2017, we promptly filed your Offer based on your statement that you could not pay. You claimed a refund in 2016 but you told us that this was as a consequence of a one-time child care credit which you never paid IRS in the first place but which you applied for on your 2016 tax return. In fact, your income increased substantially during 2017 and 2018 which you did not share with us or IRS. We argued and convinced IRS to ignore the 2016 child care refund as it was a one-time event. Your contention that we ever told you or anyone else “not to worry about penalties and interest” is manifestly untrue. However, you never told us your income increased substantially (like more than two times and almost 3 times) during 2017 and 2018 to the point where IRS determined you could pay more than the $500 you offered. We have compromised over 302 cases and saved taxpayers over $53,000,000. Those cases qualified for Offer acceptance on the grounds of doubt as to collectability. You failed to let us know that your income increased so substantially in 2017 and 2018, that you could pay more than the $500 you offered which resulted in IRS ultimately rejecting your Offer after we appealed your case to the highest IRS level. I am sorry that you, like everybody, who can pay, must pay what they can. We are attorneys and not guarantors of results, and your failure to be candid with us about your increased ability to pay did not help you. We have always communicated with you promptly and courteously and will continue to do so. We always take suggestions and criticisms most seriously and we respond promptly.
