Mr. Gerber is a business, corporate and trial attorney at MAC. Focusing his practice, with more than 10 years of trial and litigation experience, on helping business owners navigate complex legal issues faced in the unique environment of Las Vegas and Nevada, Mr. Gerber has built a solid reputation as an honest, pragmatic, aggressive advocate on his clients' behalf.
Born and raised outside of Cleveland, Ohio, Mr. Gerber graduated law school in 2002 among the top of his class and with honors. Rather than immediately join private practice, Mr. Gerber chose to first serve his country by volunteering to join the United States Army, following in the footsteps of his grandfather and brother. From 2003 to 2006 Mr. Gerber (then Captain Gerber) was an officer in the Judge Advocate's General Corps representing soldiers and their families. Less than a year after the beginning of Operation Iraqi Freedom, Mr. Gerber volunteered to serve as a Trial Defense Counsel in Iraq. During 2004 and 2005, Mr. Gerber served as the sole trial defense counsel at Camp Taji Iraq, located less than 30 miles from Baghdad. During his yearlong deployment, Mr. Gerber defended hundreds of soldiers facing administrative and non judicial punishment and dozens of soldiers facing courts martial for alleged crimes related to the law of war, drug trafficking, aggregated assault and murder. Mr. Gerber was honored for his work as a member of the US Army Trial Defense Service and his service in a combat zone with a Bronze Star in 2005. Within weeks of his redeployment to the United States, Mr. Gerber married his wife Tammy and began making plans to settle in Las Vegas.
In the spring of 2006, Mr. Gerber joined MAC as an associate attorney and trial lawyer in the business and construction litigation departments. Since then, Mr. Gerber has represented some of the largest companies in Las Vegas, numerous small business owners and individuals starting new businesses in areas like construction, hospitality, gaming and entertainment. Mr. Gerber has obtained millions in judgments for his clients through litigation, mediation and trial. Mr. Gerber also represents one of Las Vegas' largest commercial landlords and has pursued more than $3.5 million in claims against defaulting tenants. On average, Mr. Gerber handles more than $5 million in total litigation claims a year. Mr. Gerber has now tried more than 40 trials and pursued numerous appeals.
Mr. Gerber's practice expanded in 2010 to include the growing health care industry in Las Vegas. Mr. Gerber's litigation, arbitration and mediation practice now involves the handling of more than 50 medical malpractice and nursing home defense cases annually. On average, Mr. Gerber defends more than $1mil in medical malpractice claims each year as he brings his business litigation experience to assist doctors, nurses and administrators faced with claims relating to Nevada's medical malpractice statutory scheme.
In 2013 Mr. Gerber once again expanded the scope of his business and litigation experience by identifying the growing need for quality business perspective and representation in the sports and entertainment industry in Las Vegas. Not long after taking this leap into a new industry, Mr. Gerber helped create the production entity and negotiate a deal to add a new Vegas show to a major downtown casino. Mr. Gerber also represents the owner of various film and television productions as well as one of Las Vegas' oldest and most venerable bars.
Mr. Gerber also became a licensed manager for mixed martial arts armed combatants in 2014 and helped begin a new MAC venture to represent the business and industry needs of MMA fighters. Mr. Gerber is currently working with some of the top coaches, training gyms and up and coming athletes in the Las Vegas.
In recent years, Mr. Gerber's work has been recognized by his partners who elected him to director in 2011 and shareholder in 2014. Mr. Gerber was also recently given an AV rating by Martindale-Hubbell (the highest available rating) and has been recognized by the Mountain West Super Lawyers as a rising star in 2010, 2011, 2012 and 2013. Mr. Gerber also maintains a "Very Good" rating through www.avvo.com and was named one of Nevada's "Legal Elite" by the Nevada Business Magazine in 2013.
Away from the office, Mr. Gerber enjoys spending time with his beautiful and accomplished wife Tammy, his two boys and his lovely daughter. Mr. Gerber remains a diehard fan of the Cleveland Browns and Cleveland Indians (despite his better judgment) and enjoys college and professional sports with his family and their three dogs. Mr. Gerber is also an avid reader of history books and a devoted fan of Bruce Springsteen and the legendary E Street Band.
