mid june of 2016 I came to Karen with a WC claim I was having difficulty with trying to get my designated drs. to acknowledge I had more than just a sprain or strain after injuring same extremity twice within 2 week period. Once the results were in from MRI, a letter was addressed to the claims adj...usters and request to change diagnosis to the results shown and dr. verified change in status.. Court date was set for mid. August which I had assumed would be an in and out no problem quick fix which my attorney had reassured me there would be no issue since we had all the corresponding paperwork confirming new diagnosis....I never gave this court date another thought until rec. a letter from hearing officer on Aug. 27th denying my request to change diagnosis.. How could this possibly be?? I called my attorney several times having to leave messages with secretary, voicemails along with multiple emails requesting someone from the office please call me let me know why this has happened..??? On Sept. 1st, I returned to specialist for a recheck and was determined that surgery would be in order and scheduled in 2 weeks .. follow up in 1 week for pre-op orders, and instructions.... Soon as I was released with new orders, I phoned my attorney to let her know what his treatment plans were for me. Unable to reach anyone by phone legal assist. returned my call next day when I filled her in on the details.. She was happy to hear everything was going well and that I was finally going to be able to get this taken care of.. The day prior to my pro-op , I called dr. office to confirm my appt. for 8:00 am the following am.. Everything was good to go. I instructed the office staff to please let me know if anything changed BEFORE I jumped on a bus requiring me to travel 3.5-4 hrs. round trip ...upon arrival the following am for my pre-op exam and surgical instructions. I was greeted with a FAX that had been sent over only mins. prior to my arrival. The fax was sent from WC claims adjuster directly to dr. office. Stating... SURGERY DENIED....Diagnosis remains 'UNCHANGED '" LEFT KNEE STRAIN ONLY".. All benefits were to be discontinued.... as of 8 am .. . OMG. I was floored and overwhelmed. Soon as I was out of that office I was on the phone to my attorney of which I was really venting at the time. 3 1/2 months of waiting around playing this game with WC drs.. and jumping tru hoops with claims adjusters that refuse to pay me the hours I worked light duty tpd that they owe me from 3 months back.. NOW this. It took til then end of the following day on Thurs. Sept . 8th to hear back from attorney. And only then was I FLOORED even more. Come to find out she didn't bother to go to court on the appointed date and time because. AS she said. I was already being treated at the time. with PT 2/xs per wk. x 3 weeks. Well , that does NOT excuse this action . I was never informed that she decided not to attend this hearing. Now it has left me STUCK.. I was forded to RUSH file my own appeals which the 30 days was up on that Friday. My last conversation with Miss. Lewis was her telling me that MY KNEE was not that important to her. It wasn't worth her time or effort and she was only doing me a favor.. WHERE IS THE FAVOR>> I am starting from square one all over again. NO FMLA left , increased difficulty ambulating for and performing my reg. work duties . Not to mention my REG. adls. I was told if I had not bugged her so much and only called once every other month or so she could have continued working for me. WHAT FOR.. she hasn't even gotten my due wages for me. and was mad at me because I call to much or email because I was getting evicted. , electricity shut off, no food in house for teenage son. ya. AWESOME.
