The most embarrassing court experience in my life. The judge literally laughed us out of the courtroom .

Terry handled a contract dispute and counterclaim for my partner and I in 1999. It was a frivolous business sale contract/breach/fee for services suit. The original claim was based on the fact that I had invested in an llc that was under contract for sale and that investment constituted a sale and th...erefore a broker fee was due the listing agent. Pretty straightforward up til this point right? The plaintiff's attorney and the broker had been strong arming people in this manner for years. That is they would sue for fees even if no actual sale ever occurred. They had a horrible reputation and my partner wanted to hurt them. My partner was advised that they would settle for 25k, I offered to pay just to make this go away. But Terry told him that he could counter sue based on damages arising out of the original suit. He said that we had a case against the plaintiff because were not able to re-sell our business in a timely manner, it was a night club and we had a buyer who backed out because of the pending litigation. Terry convinced my partner that he could win huge, upwards of a half a million dollars, I remained very skeptical. Once we arrived in court however Terry's case was systematically dismissed piece by piece. Not by the arguments of the plaintiff's attorney, but by the judge!!. Finally the judge started to insult Terry, questioned where if ever he had studied. The spectators and witnesses were all laughing. Years later when Terry finally brought his fee dispute with me to arbitration the court reporter claimed that she still remembered the case because of all the laughing and said it was the worst she had seen in her 35 yr career. What could make this worse? After the judge had dismissed both sides cases against the other was the fees. Not only were they outrageous, nearly 90k, but under the manner the judge ruled Terry could have filed for re-reimbursement from the plaintiff but didn't!!!!! Yes you read that right. Terry continued to hound me for years, 8 yrs., before he finally got a lien on my property out of state. I had to pay Terry 20k to sell my home.

Let me relate what really happened. I was retained in 1999 by a gentleman named Ron who owned a business in Tucson. He had been sued by a business broker for an alleged breach of a listing agreement for the sale of the business. Ron had signed a listing agreement with the broker who failed to produce a buyer for the business as he indicated he would forcing Ron to take on a partner -Steve became that partner. Steve was dragged into the litigation by the broker and wanted to join with Ron against the claims by the broker. Ron agreed to allow Steve to join with him and have me also represent Steve provided Steve sign a waiver of conflict of interest as well as an agreement to equally share the cost of my services which he did. Steve’s position was that he would not consider settling the lawsuit by paying any sum of money – he was outraged by the lawsuit and vowed to defeat the brokers claim at any cost. Ron had filed a counter claim against the broker based on the broker’s breach of fiduciary duty and retained an expert to support that claim. Ron’s expert was and is a very well respected attorney in Arizona practicing primarily in the Tucson area where the case had been filed. Ron’s expert testified at trial to the standard of care required of brokers and detailed how the broker had breached those duties. The case was tried to a jury and went for five days - it was hotly contested and the broker had very competent counsel. Unfortunately, just prior to submitting the case to the jury the Judge took it upon herself to dismiss our counter claim, a decision I disagreed with and argued against. Nevertheless, had it not been for the evidence we were able to put on in support of the counterclaim, our expert testimony in particular, it is very possible we would not have prevailed with the jury as we did. The jury came back with a defense verdict in our favor shocking the broker and his lawyer who had been crowing over their expected victory and what they anticipated would be a $50,000 plus damages verdict on top of an award by the judge of $100,000 for attorneys fees incurred by the broker. The fact of the matter is that we prevailed with the jury on a very difficult case with a lot at stake- if we had not prevailed with the jury Steve would have been stuck with a judgment against him in the approximate amount of $150,000 on top of the amount in attorneys fees he owed me for representing him in the dispute. Ron was elated at having prevailed in the lawsuit. Steve on the other hand was looking for ways to avoid having to pay me what he owed me. If Steve had paid me or even made an effort to compromise with me, there were causes of action I could have pursued to recoup the attorneys fees and other damages resulting from the lawsuit. Steve however refused to communicate with me leaving me no opportunity to confer with him regarding his available remedies and I certainly could not have exercised those available remedies without Steve’s authorization. Ultimately I offered to resolve the matter of my outstanding legal fees thru the State Bar Association fee arbitration program, a client friendly forum geared to assist the public with fee disputes with lawyers. Steve agreed to arbitrate the matters in dispute and we presented our cases to the three person panel that had been appointed by the State Bar Association. The panel determined that Steve’s claims were without merit and awarded me the fees I was owed. Steve nevertheless persisted in his refusal to resolve his obligation to me and caused me to hire a collections lawyer to pursue him. At any step along the way I would have been willing to work something out with him if he would have made an effort but he did not. It is exceedingly rare that I have had to take measures of this sort to protect my interest but Steve left me no choice. It is apparent that Steve does not like taking responsibility for his actions and is not happy having been held to account for his obligations.

Worst lawyer you could hire

Every time we went to court, my ex had to pay 90% of atty fees. I had given Dunmire a retainer of $5,000 and after deducting the 10% of court and atty fees owed, I not only did not get a refund from the monies left over from the retainer, I received a bill for thousands more. In the end, I lost 9 ye...ars spousal support totally over $300,000 and he never even had the ethics to tell me. Do NOT hire this guy, you are in for nothing but heartache and Trouble.

Dawn retained me to enforce her divorce decree and collect past due spousal maintenance from her ex husband. During my involvement in her case I was successful at every turn as all the pleadings and court orders in the case demonstrate. Time and time again the judge found her ex husband in contempt and ordered him to pay past due spousal maintenance and attorneys fees at the risk of incarceration. Unfortunately for all concerned her ex husband lost his high paying job. He filed a petition to reduce his spousal maintenance obligation and under the circumstances was almost assured of prevailing. Dawn could not accept that the law would work that way and became so difficult to deal with that, with her written consent, I petitioned the Court to permit me to withdraw from representing her in the case. I had withdrawn before the court hearing regarding her ex husbands motion to reduce his spousal maintenance obligation- yet she blames me for costing her over $300,000 in spousal maintenance. If I had done anything to jeopardize her spousal maintenance I would be the first to admit it and would have availed her of my legal malpractice insurance which I maintain to protect my clients should problems like that occur – fortunately in my 35 years of practice I have never had a claim. Dawn never contacted me about her dissatisfaction and I wish she had. Her case concluded in mid 2006 and she did not post her review until the end of 2013- apparently with the passage of time and distortions of memory she chose to vent and malign me on AVVO. I am very sorry Dawn’s situation became so difficult for her and that she became unhappy with my services but as with every client I represent I did my best to help her achieve a favorable result in her litigation.
