Stephen Biggs focuses his practice on appellate work, preventing and solving business disputes, and protecting the reputation and intellectual property of individuals and businesses.
Appellate Practice
Stephen assists individuals, businesses, and other lawyers in appealing a ruling from one court to a higher court and in defending against appeals taken by opposing parties. His appellate experience includes cases involving many different areas of the law, including business and commercial disputes, questions of statutory interpretation, issues regarding the enforceability of contractual provisions, criminal matters, defamation claims, and unemployment insurance benefits—to name a few.
Most frequently, clients and other lawyers hire Stephen to assist them in bringing direct and intermediate appeals (incluidng special actions) before the Arizona Court of Appeals. But Stephen has also prepared multiple petitions for review to the Arizona Supreme Court, and he has briefed and argued two cases accepted for review by that court. Stephen also has experience briefing and arguing cases in the federal courts of appeal, and he has assisted or consulted with other lawyers in pursuing and defending appeals before appellate courts in states outside of Arizona.
Preventing and Solving Business Disputes
Stephen helps individuals and businesses avoid and solve disputes, both before and after they become lawsuits. Effective risk management (including seeking the advice of a lawyer about how to prevent and protect against legal problems before they occur) and early negotiation to resolve problems that do arise before they become lawsuits can oftentimes keep individuals and businesses out of court and avoid the costs of litigation. But when litigation is necessary or a court action has already been filed, Stephen assists businesses and individuals in pursuing or defending against legal claims in court or in arbitration.
Some examples of the types of problems and situations that Stephen helps his clients avoid or address include contract disputes, unfair competition, disclosure of confidential information, fraud claims (including claims for consumer fraud, securities fraud, and other forms of investment fraud), business management disputes (including claims for breach of fiduciary duty, self-dealing, or disloyalty against officers, directors, and other managers of businesses), business ownership disputes (including business break-ups), failed business deals, trust disputes, and professional negligence (including malpractice claims against accountants, auditors, and lawyers).
Protecting and Defending Reputations and Intellectual Property
Your good name matters, whether you are an individual or a business. In the age of the Internet, it is easier than ever for harmful, negative statements to be communicated to large audiences instantaneously. Stephen assists individuals and businesses in protecting their reputation when others defame, slander, or libel them. He also assists those who have been accused of defamation, slander, or libel in defending against those claims.
In addition to reputation, another valuable asset of every business and entrepreneur is intellectual property. Stephen assists individuals and businesses in pursuing and defending against claims of trade secret misappropriation, copyright infringement, trademark infringement, Lanham Act violations, and other forms of unfair competition related to intellectual property rights (including palming off and passing off claims).

Stephen Biggs is an excellent attorney. He is bright, smart and works in my company’s best interest. Even better, the judge and arbitrator over our cases trusted Stephen and had a lot of respect for him and his work. I give him the highest recommendation. I am very grateful for his service to my firm...

Mr. Biggs has a deep understanding of the law and has the unique ability to cite legal statutes from his many years of study. He also proves that the pen is more powerful than the sword with his letter writing ability which---I believe---is the most important asset a lawyer can possess.

With ONE expertly crafted letter, Attorney Biggs was able to get a multimillion dollar corporation to think twice about pursuing legal action against us. His knowledge of the law is impressive and he kept us informed every step of the way. He is extremely intelligent. We highly recommend him and if n...

Stephen Biggs was an opposing counsel on a very complex, and contentious, litigation. Despite the disagreements between our clients Stephen was a pleasure to work with - professional and responsive. He is a passionate advocate for his clients and extremely knowledgeable of the law. I highly recomm...
"Stephen is the most intelligent, hard-working, dedicated, honest, conscientious, high-quality lawyer I have had the pleasure of working with. As a former co-worker, I had the opportunity to review his work and rely on it on several occasions, and I always came away with the feeling that if my work product could ever approach his in quality, then I would be worth my salt as an attorney. He provides the best in legal services on cases ranging from drafting a will for a small estate to arguing in front of the Arizona Supreme Court. Stephen is not only the highest-caliber of attorneys, but he is also a man of unimpeachable integrity. I have known him for over a decade, and I know how much he cares about providing the best in legal services to each and every client. If I ever needed a lawyer in Arizona - for myself, a family member, a friend, a client, or an acquaintance - Stephen Biggs would be my first call. I would beg him to take my case. You should, too."
"Stephen is a shrewd and highly skilled litigator. His analytical skills are top notch and he is a very fine advocate. I highly recommend Stephen."
"I endorse this lawyer. Stephen is a highly experienced and successful appellate and business litigation attorney. I would highly recommend him to any client."
"Stephen is an excellent lawyer, period. I have known Stephen since he clerked at the Arizona Court of Appeals, prior to his clerkship at the Ninth Circuit. Even at that early stage of his career other court staff, including judges, were impressed by Stephen's dedication to his work, strong writing style, and smarts. Later, while we were both in private practice, we were able to work on nearly the same side of a complex commercial litigation matter. Stephen not only knew the complex record that was developed, but also was very pleasant to work with on this difficult matter. I am certain Stephen and I will work together on future matters and I am looking forward to that."
