Melissa: While I appreciate your opinion, your facts are inaccurate. First, your adult daughter hired me, not you. You simply provided payment. Second, we not only opened your daughter's file, but as part of my initial review I went through 122 pages of legal documents, narrative from your daughter and text messages. I spent additional time trying to open two audio recordings you sent over with an email saying “Hope it works”. Third, you should not have had to look at my face to understand it was a tough case as I made that very clear as we went through the situation in my office. Additionally, as your daughter was seeking to file paperwork on an emergency basis I set aside the work I was scheduled to complete and performed all of the above within 24 hours of retention. Fourth, after my careful review of all of the documentation I sent a very detailed and specific email to your daughter indicating why I did not believe she had grounds for a filing on an emergency basis. Her email back indicated agreement with my advice and based on that no further work was done on the file. Fifth, despite my practice of preparing and sending billings on the last day of each month and if appropriate issuing a refund check at that time, at your request on June 26th I spent the time running a separate billing for your daughter’s case and issued a credit card refund despite incurring additional service charges for handling it that way. Sixth, when you made it clear you believed the amount charged was excessive, I invited you to review the bill and let me know if there was a particular charge which you believed was incorrect or needed adjusting. As of today, you have not done so. Finally, if I truly were unethical, rather than giving my opinion that it would be a waste of your money to continue, I gave my honest opinion based on my 35 years of practice as well as what I believed was in your daughter’s best interests and very quickly refunded the unused funds and closed my file. I believe that to be a clear reflection of the very high level of competence, professionalism and ethical standards we employ at Cohen Family Law.
