Replied last September 04, 2019I understand that divorce is a very difficult time, and that sometimes it's hard to recognize a good outcome when you didn't want to be divorced. 1. Your wife is a stay-at-home mother, and you ended up with 50/50 custody. 2. You had a ten year marriage and paid three years of alimony. As we discussed, we don't typically do complex tax analysis, but instead employ the same analysis the court uses to determine net income (25% reduction from gross) as set forth in Hansen v. Hansen case (325 P.3d 864 (Utah App. 2014)), which holds that “It was within the trial court’s discretion to employ the 25% tax rate and to equalize the parties’ monthly shortfalls in calculating alimony.” That was proper analysis and one the court usually uses. Sorry for all you're going through, and I wish you the best of luck going forward.
