Part of the justification for the “mere legal error” doctrine is that
making mistakes is part of being human and is inevitable in the context in which most attorneys decision-making takes place. It is not ethical to cover up your mistakes nor ignore the abuse that is taking place in a family dynamic because you dont have the skills to deal with the issues at hand. Susan blamed the abused and is not skilled in high conflict - she should of recommended a more skilled attorney but didnt.
