What an interesting review; notice the lack of detail? The first phone call. This client left a message on a Friday evening indicating he had an urgent custody matter. When I returned his phone call the following morning, Saturday, he was too busy to talk stating he was driving and going “four wheeling.” Fortunately, a family member suggested he pull over and discuss his custody matter. Interestingly, this client knew that his custody matter was on a downward trajectory several weeks earlier, but delayed contacting an attorney. He went on to describe the custody issues, which involved a court case on Monday morning (yes, just 48 hours later). I informed him that I was unavailable Monday morning at 9:00 a.m. due to pre-existing legal matters, at which time he immediately became angry, resulting in me having to remind him that it was HE who didn’t even want to talk initially. This client represented himself at the first emergency custody hearing all with an open Children and Youth investigation pending. The following week while I was in Court with other clients, yes, actually in a courthouse - either in a courtroom or on a bench with a paying client - this client repeatedly demanded that I contact him immediately. I deem this to be inappropriate. When he did not receive an immediate response from me, he became further agitated. I even had to explain to him later that evening that, if I was in Court with him, he wouldn’t be paying me to be discussing other matters down the hallway on my cellular phone. Subsequently, during yet another phone call, this client stated, “I don’t trust the legal system and you’re a part of it.” Thereafter, I explained that a client and attorney need to be on the same team and that it was clear that he viewed me as his adversary. Despite this client wanting to continue with representation, I terminated the representation. Here are the takeaways: always make your case a priority; do not engage in self-representation, especially where there are complex legal issues; it’s okay to be frustrated but know that your attorney is on your team even if the facts or laws are not; and finally, know that a reasonable time for a return call is the same day or the following day. Expecting an attorney to respond to your communication when with another client is inappropriate and unacceptable.
