OUTCOME: 5 - 1 for not guilty then good plea

My client turned left and got in an accident. He is a teacher. The only person hurt was his wife. She was not angry with him. The accident was caused when cyclists violated traffic laws thereby d ... istracting him so that his focus was to avoid the cyclists. He did avoid the cyclists. Unfortunately, he did not see the other truck. The DA refused to listen to anything and the only offer was to plead guilty to the charge. We went to trial. 5-1 for not guilty. A juror called me and said the 1 was unreasonable. The juror was upset and wanted to make sure we won the next time around. The DA made a reasonable offer and my client accepted it.

Boulder DA refused to entertain any deal on a careless driving charge. In discussing the case with my client, he was being careful, but he just made a mistake. The final vote was 5-1 for not guilty. ... One grumpy juror held out to deny us a complete acquittal. We might try this again, but now the DA is offering a very favorable deal.

This case was in the papers regularly. Because of the press, the offers were not close to fair. So, we went to trial. My client was facing a mandatory 10-32 years of prison for participating in a ... dispensary robbery. We tried the case to a jury on an identification defense. In the middle of trial, new evidence came out of my client telling her mother in a recorded phone call that she did it. (we could have won on ID had that call not come in - never talk on the jail phone). We kept fighting. We did not give up in the face of horrendous odds. The jury saw my client's humanity and their verdict reflected it. The jury found her guilty of a lesser offense allowing her to get probation.

OUTCOME: dismissed after hung jury 10-2 Not Guilty

A grandfather was charged with sexual assault on his grandchild. There was no offer and we brought the case to a jury in Boulder. The court allowed the prosecution to present evidence of similar ... allegations by other grandchildren. We were able to show that the child's motive in this case was to protect other presumed victims. She was not assaulted, but because she was older and believed the younger kids were hurt, she made up this allegation. The jury hung 10-2 for not guilty. The prosecution decided not to retry the case.

In the last year or so, I have been able to get several DUI cases dismissed. In one, I successfully argued that the police destroyed excupatory evidence, thereby violating my client's due process right ... s. In another, the judge agreed with my argument that the police did not have probable cause to arrest my client. In a third, the prosecutor agreed the police did not have sufficient reason to contact my client. In a fourth, the court dismissed the case after I demonstrated that the police did not follow required chemical testing procedures. Further, in a recent DUI trial, the jury acquitted my client after I showed the police did not follow the correct procedures on SFSTs (roadside sobriety tests).
