The hearing my client refers to is the Meeting of the Creditors. This is a Federal Court proceeding and both my attendance and my client’s attendance are mandatory. Failure to appear at the hearing will subject my client potentially to a dismissal of his or her case. Clients are given 3 to 4 weeks advance notice of the hearing so continuances are not frequent. If my client cannot physically attend due to an illness for example, I am required to attend the hearing regardless and request a continuance to another date, mail notices of the continued hearing to all of my client’s creditors and attend the subsequent hearing. If the client learns a reasonable time before the hearing that he or she cannot attend (which is rare) and allows me sufficient time for me to confer with the trustee, request a continuance and notice the creditors of the continuance before the hearing, I am not required to attend both the initial hearing and the continued hearing. In either case, given the mandatory nature of the hearing and that additional legal services are required if the client fails to attend, I charge additional fees. The $300.00 fee is set forth in my fee agreement which I review with each and every client before they sign it. I am considerate of all of my client’s circumstances, am sensitive to the fact that my client’s are in financial crisis, and strive in every case to easy their stress.
