Client and a friend were riding around in friend's car when they got the bright idea to steal UPS packages off of front porches. A neighbor saw client running from a car to a front porch, grabbing a p ... ackage off the porch, and running back to the car to leave. The client and driver were pulled over, but after a search, cop couldn't find anything. The alleged victm claimed that a box of chocolates were stolen, but since nothing was found on the client, the case was dismissed.

OUTCOME: Grand Jury No Bills

Client is a Law Enforcement Officer who shot and killed a suspect who had fled from a known drug house in a vehicle. The client, a Deputy with the Montgomery County Sheriff's Department, pursued the s ... uspect into Harris County. The suspect was pointing a shotgun to his head during the chase and driving erratically. Eventually the suspect pulled into a driveway and walked to the front door of the house. At the front door of the house, the suspect pointed his shotgun at Client, at which point the Client, another Montgomery County Sheriff's Deputy, and a Tomball Police Officer all fired at the suspect, who died at the scene. The Grand Jury, after hearing the evidence, decided not to charge my client.

OUTCOME: All cases dismissed.

Client was in the process of buying a house from her previous boyfriend. She was sunbathing topless in the backyard next to the pool. Closing day for the purchase of the house was just two weeks away ... . Unbeknownst to my client, her prior boyfriend and prior boyfriend's ex wife decided to come to the house to use the pool too. When the prior boyfriend and ex wife showed up to the house, the ex wife became enraged that the client was there and decided to get in her face. A fight ensued. Both ladies had been drinking. When the cops showed, they decided to arrest client because the ex boyfriend decided to take the ex wife's side (he wanted to get back into her good graces). There were no marks on the alleged victim, yet my client was arrested for assault, indecent exposure (because she was sunbathing) and interfering with an emergency call. The ex boyfriend later changed his story and it came out that the client was in the process of buying the house. The prosecutor dismissed the case on the eve of trial.

At 8 pm one evening, the alleged victim states the client cut her right ankle with a pocket knife. She stated that she and the client were arguing. The problem with the case was that she reported it ... the next day in the afternoon and the injury was so barely visible that it was laughable. Client claimed alleged victim was kicking him when he dropped the knife on her ankle by accident while he was trying to get a hangnail out of his hand. It was a case of an accident and an angry girlfriend.

Deputies accused my client of hitting his brother in the face. This is another case of mutual combat, where my client and his brother were fighting over who would drive the car. Client decided to accept a $200 fine on a fine-only Disorderly Conduct Charge--Using Profane Language in Public. This is a pretty harmless fine-only offense.

OUTCOME: Reduced to Obstructing a Highway

Client crashed his car into a fence while driving around a curve in the countryside. Cops showed up and administered field sobriety tests and then got a breath sample from client that came back 0.202 ... BAC. Case closed right? Not really. The DA's Office would have had a hard time proving client was driving and intoxicated at the same time, since the person who saw the accident left the scene.

OUTCOME: Case Dismissed

My client's DWI case was set for jury trial when I asked the Judge to dismiss the State's case because the State was withholding evidence favorable to my client. Specifically, Katy PD took my client's ... blood to have it tested and it appeared that the blood evidence was lost. The DA's Office scrambled to find this blood evidence so that their case wouldn't be dismissed by the Judge. The blood evidence was eventually found inside a refrigerator in the Katy PD evidence locker after a year and a half. It was never sent to be tested. The blood was then tested and came back 0.02, well below the legal limit. The State then dismissed the case without a ruling from the Judge.
