Steer clear
He revised a will of a sick aging couple while failing to recognize all the telltale signs of elder abuse.
Attorneys have a duty of confidentiality to clients. Therefore, they do not readily report to state officials information acquired from clients. However, reporting elder abuse is required by law even when the information comes from clients, and I have made such reports, even against the strong wishes of the clients. Apparently I did not have information in the case complained of that led me to believe such reporting was required. This would be a good time to suggest to the complainant and to others that because of the duty of confidentiality to clients, it is not the best practice to rely on attorneys to violate confidentiality in that way. Any person with reason to believe that a person who has reached age 65 is being subjected to abuse, neglect (including self neglect) or exploitation has a duty to report it to Adult Protective Services by calling APS at 1-800-252-5400 or reporting online at https://www.txabusehotline.org .
