Nathan's trademark strategy and advice were exactly what I needed. In bootstrapping my start-up, I am highly cost conscious and constantly evaluating the ROI of outsourcing v. do it yourself. Submitting a trademark application seemed pretty straightforward so I chose to do it myself. To my dism...ay, I received an Office Action from the USPTO indicating that our submission was “merely descriptive” and therefore could not be registered on the principal register. However, the term could still be registered on the less protective secondary register. Since I hadn’t even known there were two registers and didn’t know how much time and cost would be required to understand the details and submit an argument I strongly considered abandoning the effort. The slew of letters I received from attorneys all over the country offering to submit a response on my behalf for as low as $149 didn’t make me feel much better. In general they simply wanted me to have them submit paperwork conceding my submission was “merely descriptive” and accept registration on the secondary register. A few months later, I met Nathan and RC, at a legal panel for entrepreneurs. Figuring it couldn’t hurt to ask their advice, they reviewed my trademark application, explained the options, and indicated I had a case for the principal register. Given my cost concerns, they came up with an arrangement that fit my budget, provided the legal guidance I needed and now I have trademark protection on the principal register. Woohoo!
