missing in action

I paid Ali a $20,000 retainer and am now switching attorneys. My counter-claim was not filed until 32 minutes before it was due and it was missing a $65 fee, which caused delays in serving people. Ali said he would file a "no-evidence summary judgement" last week; however, this was never filed, ac...cording to my new attorney. Ali expressed disapproval with me for showing up in court and asked that I not participate or be pro-active; therefore, I went on vacation for 10 days. A week after I returned, I discovered that nobody on my case had been served. Ali asked me to refer him several other cases, which Ali offered to consider on contingency. Shortly after sending referrals, I was informed that Ali did not seem interested in their cases and Ali began asking me to renew his retainer, again to $40,000. I never received feedback or accounting information from Ali other than to ask me to renew his retainer. After speaking with several other attorneys about this situation, I discovered that there should have been milestones established and that I should find another attorney based on the lack of accounting information provided by Ali. We have not begun discovery for my case; therefore, I'm not sure how this is possible. I did not get positive feedback from anyone with regard to my experience with Ali and when I requested to meet with Ali to discuss accounting, Ali did not return my phone calls, e-mail or provided feedback. As I am now terminating Ali as my lawyer, Ali contacted my friend who referred me to him and my friend and I both feel that this was inappropriate. Anytime I have questioned Ali about my case, the response I get is that I am free to terminate his services. This response became typical shortly after paying Ali his retainer and I have only met him twice and spoken with him on the phone a few times. The e-mails that I sent Ali were mostly referrals, which he requested; therefore, I'm not sure how much time he actually spent on my case. I have not received feedback from Ali to understand what he has done, what is going on or why he took my case.
