I wish I could give 0 stars. Don’t believe on the 5stars review without checking the lowest ones?

SE PUDESSE, DARIA 0 ESTRELAS! FUJAM DESSA FIRMA! DO NOT BELIEVE ON THE 5 STARS REVIEW WITHOUT CHECKING THE LOWEST ONES!!!

Unreliable, Untrustworthy, Unpredictable

At first, he will appear to be understanding and empathetic. It is a facade. The reality of David Breston is that he is unreliable, untrustworthy, and, surprisingly, unpredictable in his attitudes and responses. Please be reminded that I am writing based on my personal experience with him and his fir...m on a first offense, Class C. With that being said, it is possible he will not hesitate to make unilateral decisions about your case without consulting you. If you are able to figure out what he has done and question him about his actions, he will possibly ignore you, lie or refuse to answer your questions. He could, also, blindside you by sending someone you have never met to your hearing without communicating this to you in advance. This individual will know nothing about your case and, as a result, place the outcome in jeopardy. In addition, he could fail to read important documents you send him. He may choose not to educate himself on your case, yet use bombastic language while promising you guaranteed results. He will, likely, provide no reasoning behind his bold assertions, but expect you to put your full trust in him. He could make your case more difficult than it has to be simply because he chooses to be unprepared. It is also possible that you will be hurt, disrespected, and mistreated by him, depending on his mood, with no accountability on his part. If you have been traumatized by your experience with the justic system, it is possible that his behavior will add to that trauma. It will be nearly impossible to predict how he will respond to things. He may be kind, he may be cruel. However he chooses to respond, it will have nothing to do with you, but you will be expected to simply accept it. It will seem that he has forgotten that he works for you, not vice versa. All in all, if he can potentially fumble a low-level, fine-only offense, as was the case with me, you could very well be gambling with your future if your offense is much greater. Ultimately, the choice to hire him is yours. I cannot and would not tell you what to do. I can only express to you possibilities and potentials based on my own experience. I hope I have been helpful.

Please Please Please Do Not Hire David (for your own peace mind)

I made an account just to write this review. I really hope it helps someone not make the same mistake I did. I hired David to help with a misdemeanor charge. He seemed nice enough until I paid him. It went sharply downhill from there. He never took notes and therefore asked me the same questions ...over and over every time I contacted him. He talked extremely aggressively especially when I asked questions about what his plans were or anything that involved details. He would also make sure to mention how ever though I told him exactly what happened and the charges were false he somehow still made me feel like I was guilty even though he was supposed to represent me. it felt that he was interested in spending the least amount of time and effort (I prepaid him a lump sum) my best interests be damned. The absolute worst thing however is that David had me sign a protective order which has given my ex wife the power to not let m see my children for 10 months and could very possibly end up costing me custody. I'm not sure if it's incompetence, laziness or a problem with overweight people (I'm not even joking), maybe its a combination but the services rendered by David Breston have added a tremendous amount of stress to my life. Thankfully I switched attorneys who got the case dismissed (to be expunged) without any problems at all. In summary I absolute do not under any circumstances recommend this attorney.

Never again!!!!!

My husband made the mistake of hiring this man. From day 1 when we met him, i got nothing but bad vibes. As we sat in his office talking over misdemeanor case, all he he did was sit there on his phone and after he was done doing whatever he was doing on his phone, he just look and question us what di...d we want to do with the case. What kind of question is that?!?! He gave no recommendations because according to him we had to hire him first. Any lawyer that knows his stuff and wants to hired gives you opinions and options on what is to happen with the case. I had to step out of the room because we had our toddler with us and Mr. Breston seemed very bothered with his presence there, he did nothing but give dirty looks to my 1 year old. That's when without my knowledge he had been hired by my husband. All 3 times my husband has had court he has never been present, he sends his paralegal because misdemeanor cases & i quote "are not important to him, he only deals with the big cases" Yesterday my husband had court and called Mr. Breston office to inform he was stuck in traffic and was going to be 10 minutes late well the secretary said she would call clerks office and inform them. When my husband got to court he got arrested for being late and the paralegal did nothing knowing he was late. This has by far been the worse experience and we still have to put up this horrible lawyer and his staff. Every time we have called asking questions about the case they always give us the same answers, we need to look up your case we'll give you a call back & never get calls back after we constantly call. The only time they reach out to my husband is when they need him to pay up. Lord knows we are beyond done with these people and looking forward the end of this case. We have been through hell & don't wish this nightmare on anyone else. Look elsewhere for your own good! !

You need to read this before hiring David Breston to represent you!

I hired David back in November after being arrested and charged with two offenses that I didn't commit; misdemeanor family assault and felony evading arrest in Harris County. In our first meeting, David was confident that he could obtain the results that I was hoping for and even told me that he had ...a really good relationship with the judge in the court that my cases were assigned to. So, I hired him with confidence that he would work to resolve my cases. Prior to my first court date, David advised me to have my wife, the complainant in my assault case, accompany me to court to show her support for me. I questioned this because the court issued a restraining order against me as a condition of my bond. However, he assured me that it would be the right thing to do and I therefore decided to do so. That morning in court, I waited around for David to show up for almost two hours after they called docket and the judge began seeing defendants. Then two women came and called my name and came over and said they were associates of David's and that they were there to fill in because David was busy. Really, I'm paying this guy thousands of dollars and he sends me someone that knows nothing about me or my cases. So, she went up to the judge and prosecutors and came back and asked me why on earth did I bring my wife into court with me? She said the judge and prosecutor didn't take that very well because I was breaking their restraining order. I explained that David advised me to do so and she promptly responded "No, David didn't advise you"....she wanted to make sure and cover his rear. He could have been sanctioned by the courts if it came to light that he advised me to break the law. So, I go up to see the judge and she tells me that I would not be going home with my wife that day and instead I would be reporting for community supervision. So now, because of David, I've not only angered the judge but I also have to go pee in a cup, undergo evaluations and pay more money to the county each month. Strike one! David never accepted responsibility for what he did and instead stood by his advise. So to shorten this up a little. That day, the ADA was also upset about what I did and they started looking for a way to enhance my charge from a misdemeanor to a felony family assault with bodily injury. So, my next court date rolls around and it's for the felony evasion. David actually showed up on time this time. He goes and talks to the prosecutor and comes back several minutes later and approaches me with a plea offer. They would drop the felony evading if I plead guilty to the misdemeanor family assault and they would sentence me to 180 days in jail, fines and 3 years of unadjudicated probation. I said absolutely not and he threw a hissy fit and told me I was making a mistake because they would enhance my assault to a felony and I'd be looking at 2-10 years of prison. I told David I wasn't going to jail for something I didn't do and he sat right there and questioned the validity of my proclamation of innocence. Really, was my lawyer treating me as though I was lying. Needless to say I was done with this shyster. I fired him and hired a much more reputable lawyer and its two months later now and that lawyer attended the states presentation of my cases to the grand jury to obtain an indictment and presented my side of the story, lie detector tests and a statement from my wife, and the grand jury denied the indictments and "No Billed" both of my cases. David wasn't even going to attend that grand jury hearing...he told me there would be nothing he could do. In closing, David cares about nothing but maximizing his hourly rate by disposing your case as quickly as possible. He deals in high volume, so he doesn't really want to work for you. If you are facing a crime that involves possible jail time, DO NOT HIRE David Breston. You will be throwing your freedom away!
