Why are some criminal cases dismissed and other's require a jury trial? Cases are not dismissed because of the relative wealth of the client. Cases are not dismissed because of the location of the law office. Cases are dismissed because the prosecutor assigned does not believe the evidence can support a jury verdict of guilty. In criminal matters that fact is the key to obtaining a dismissal. This only works if opposing counsel feels your lawyer is ready and willing to stand and fight for you in front of a jury. I can only hope that my willingness to fight provides comfort during the stress should a trial be required. I will be prepared to present your truth by establishing the logic and reasoning of our goal's based on the evidence. The narrative that fits the evidence with the least mental effort will usually belong to the winning side.
Civil matters can be won or lost well before a trial advocate is needed. If the matter is civil in nature, the evidence is determined by the amount of effort placed into the discovery process. A settlement cannot happen if the documents that would force a setllement are never introduced during the discovery/deposition/interrogatory phase.
I find it beyond easy to treat the other side with respect and professionalism. Ironically, all who know me also know that I will protect my clients with the intellect, aggression, speed, and clarity required to allow the jury to consider all evidence ... period. This is rarely an issue in criminal mattters, but can be quite common in civil litigation.
