David Leon Pratt II

David is a franchise, trademark, and appellate attorney who handles a diverse range of legal matters which include both transactional and litigation issues. David focuses the majority of his practice on providing counsel to both franchisors and franchisees on the various aspects of franchise law by using a full-perspective approach and considering each client’s unique business system in developing legal strategies. He frequently assists business owners with identifying and protecting intellectual property, as well as the processes necessary to comply with federal and state franchise disclosure, registration, and business opportunity laws, including preparation of federal franchise disclosure documents, state-specific notice and registration applications, negotiation of multi-unit franchise transactions, and preparation of franchise and licensing agreements.

To maintain an unusually balanced practice, David also maintains an ongoing role in litigation, with special emphasis on appellate issues, such as dispositive motions, jury charge preparation and argument, preservation of error, and other matters likely to be taken on appeal. He has provided litigation support for numerous trial-level cases and has briefed and presented oral argument in several appeals to the Texas courts of appeal and the Texas Supreme Court.
