Sorry, this "client" is wrong, I am still "par excellence!!!". Of course, the person is not considerate enough to say who they are but I suspect it is a former secretary at our law firm who was let go (by a different lawyer). I did at least two cases for her - the first time for free (in a whole other county) and the second time at a greatly reduced fee. I only charged her $500 for something that should have been, given the time involved, $3,000 - $4,000. 'No good deed goes unpunished'. Her fight was with an ex-boyfriend who she blamed for everything in her life. Now, she has found someone else to blame apparently. And, I must say, I take great offense to "he was aligned with the other sides attorney". I have practiced law for some 33 years now and NO ONE has ever said anything remotely like that about me before and nothing could be further from the truth.

Too Busy

John doesn't quite have the facts correct. This was an hourly fee case - not contingency. An initial demand letter is required by Texas law in order to trigger additional damage recoveries - e,g, attorney fees. It also lets facts develop before incurring additional fee costs. This was a home remodel case. Turns out John did not have a good address for the (illegal?) immigrant contractor so he couldn't be sued easily and certainly not collected from. And, the big box store had not provided that individual to John under their program of associated contractors. John would never have gotten any money from any lawsuit. The settlement for materials only that was offered by the store (far more than they had to do) was apparently accepted by John which is the best result he could hope for. That is exactly the kind of ethical, considerate sound advice and service one should expect from their lawyers.
