Too Busy

John doesn't quite have the facts correct. This was an hourly fee case - not contingency. An initial demand letter is required by Texas law in order to trigger additional damage recoveries - e,g, attorney fees. It also lets facts develop before incurring additional fee costs. This was a home remodel case. Turns out John did not have a good address for the (illegal?) immigrant contractor so he couldn't be sued easily and certainly not collected from. And, the big box store had not provided that individual to John under their program of associated contractors. John would never have gotten any money from any lawsuit. The settlement for materials only that was offered by the store (far more than they had to do) was apparently accepted by John which is the best result he could hope for. That is exactly the kind of ethical, considerate sound advice and service one should expect from their lawyers.
