Over a year ago I was pulled over for speeding and accused of DUI, alcohol. After an hour or questioning me and putting me through the field tests they took me to a hospital to take blood. (In Collin County they do not allow breathalyzer and only take blood.) My blood came back as a .089 Hearing abo...ut David through a friend, I talked with him and we discussed the fact that a 'not guilty' verdict in Collin is more difficult than in Dallas due to several factors: they won't reduce the charge, they take blood, and it is a very conservative area. Over the last year I have been in touch with David frequently, meeting with him (or his staff) on occasion, and they have always gone out of their way to make it easy for me since I work a day job. Often we met on Saturdays, and once his assistant walked out of a conference in Dallas to give me some paperwork. I was offered several plea deals by the prosecution, but turned them all down in favor of a jury trial. After turning down a deal for 4 days in jail and a minimal fine they finally asked if I would be willing to try the case in front of the judge only, without the jury. We took this option. Knowing the Prosecution would have their own blood work expert, we hired an expert named Dr. Wimbish. As a chemist and an individual who trains people in field sobriety tests he not only questioned the process of determining the blood alcohol, the likelihood of knowing my blood at the time I was pulled over and intimidated versus one hour later when they drew the blood, but more importantly he graded me from the video of the the field sobriety test with a passing score instead of failing. Between Dr. Wimbish and David Burrows they cast a reasonable doubt on the testing procedures, the margin of error in the bloodwork, and the officer's flawed scoring procedures. As a twist, the Police had found a receipt for three drinks in my wallet and kept using it against me during the case. Instead of David arguing it, which was the most likely tactic, he used the receipt to verify the time of my last drink, which allowed him to put forward the idea that my blood alcohol level may have been rising at the time I was pulled over, and it was likely I was not impaired until an hour later when they took the blood. The judge declared me "not guilty," which says all you need to know about David's skill as an attorney.
